The Resistance Dilemma

How organized resistance to new fossil fuel infrastructure became a political force, and how this might affect the transition to renewable energy. Organized resistance to new fossil fuel infrastructure, particularly conflicts over pipelines, has become a formidable political force in North America. In this book, George Hoberg examines whether such place-based environmental movements are effective ways of promoting climate action, if they might inadvertently feed resistance to the development of renewable energy infrastructure, and what other, more innovative processes of decision-making would encourage the acceptance of clean energy systems. Focusing on a series of conflicts over new oil sands pipelines, Hoberg investigates activists’ strategy of blocking fossil fuel infrastructure, often in alliance with Indigenous groups, and examines the political and environmental outcomes of these actions. After discussing the oil sands policy regime and the relevant political institutions in Canada and the United States, Hoberg analyzes in detail four anti-pipeline campaigns, examining the controversies over the Keystone XL, the most well-known of these movements and the first one to use infrastructure resistance as a core strategy; the Northern Gateway pipeline; the Trans Mountain pipeline; and the Energy East pipeline. He then considers the “resistance dilemma”: the potential of place-based activism to threaten the much-needed transition to renewable energy. He examines several episodes of resistance to clean energy infrastructure in eastern Canada and the United States. Finally, Hoberg describes some innovative processes of energy decision-making, including strategic environment assessment, and cumulative impact assessment, looking at cases in British Columbia and Lower Alberta.

Judges and lawyers have to shape their moral competences in order to maintain their professional ethics at a high standard if they want to effectively meet the challenges that modern society will throw at them. This requirement is due to the growing expectation that they will be socially and morally responsible for the law. Thus, the need to place ethics at the heart of legal education, and to make ethical reflection pervasive in academic courses, becomes more obvious every day. Using the concept and examples of moral dilemmas is a way of facilitating this task. The main purpose of this book is to analyse the concept of moral dilemma in context of judicial and legal ethics, and to provide material for legal education. The structure of this book is designed with this double aim in mind. The theoretical part presents the concept of dilemmas on grounds of metaethics and the perspectives for its application in a professional legal context. The former encompasses situations of conflict of duties or obligations, in which the choice of one conduct necessarily prevents a different conduct, and therefore leads to an unacceptable outcome. Hence, the situation of dilemma always involves an issue of moral responsibility and the problem of “dirty hands”. How such situations are present in legal practice and how to deal with them is the main concern of this part. The considerations are divided into three levels of reflection – deontological, axiological, and moral responsibility. The practical part of the book contains an overview of 150 dilemmas that can be useful in legal ethics or other legal courses. The dilemmas are divided into chapters covering the following branches of law: criminal law, civil and commercial law, family and custody law, labour and social security law, and constitutional law. Every dilemma presents a description of the facts, a reconstruction of dilemma, its standard solution and some critical remarks from a meta-ethical perspective. The dilemmas cover situations regularly met in everyday practice, as well as examples of more exceptional challenges in connection with constitutional crises that have occurred in Poland in recent years.

Although much has been written about contemporary Poland, discussions that provide a balanced assessment of the current situation are in short supply. To correct that problem, this book offers a cross-section of intellectual opinion within Poland, including original research and works of synthesis that draw on Polish research and writing that have been, for the most part, inaccessible to scholars outside Poland. The contributors' views avoid the extremes of condemnation or defense of the system and make possible a more complete understanding of present-day realities. Their perspectives are moderated by the fact that, although the authors recognize the need for reform and change, they also take into consideration the great constraints facing all who would confront serious national issues. The discussions range from examinations of social structure and class to evaluations of the significance of the state apparatus in the analysis of policy and assessments of economic performance.
