Accountability In The Administration Of Criminal Justice

Accountability, the idea that people, governments, and business should be held publicly accountable, is a central preoccupation of our time. Criminal justice, already a system for achieving public accountability for illegal and antisocial activities, is no exception to this preoccupation, and accountability for criminal justice therefore takes on a special significance. Seventeen original essays, most commissioned for this volume, have been collected to summarize and assess what has been happening in the area of accountability for criminal justice in English-speaking democracies with common-law traditions during the last fifteen years. Looking at the issue from a variety of disciplines, the authors' intent is to explore accountability with respect to all phases of the criminal justice system, from policing to parole.

Although service outsourcing has spread throughout Canada’s prisons and jails, into its police, courts, and national security institutions, and along the border in recent decades, the expanding scope and pace of corporate involvement in criminal justice functions has not yet been closely investigated. Changing of the Guards provides a detailed assessment of privatization and private influence across the twenty-first-century Canadian criminal justice system. It illuminates the many consequences of public–private arrangements for law and policy, transparency, accountability, the administration of justice, equity, and the public. This trenchant analysis raises issues that are relevant in Canada and abroad.

Accountability is a staple of Public Administration scholarship, but scholars have been unsuccessful at developing a predictive model of accountable behavior. Large swaths of research about accountability still focuses on scarcely read annual reports as video footage of police encounters are watched and discussed by citizens regularly. In this Element, we seek to further a predictive model of accountability by understanding the norms and expectations associated with the implementation of Body-Worn Cameras. Specifically, this research examines when police departments release, or do not release, footage to the public and the expectations civilians have about the release of that footage. Indirectly, the norms and expectations associated with this technology have broad implications for societal values and the relationship between civilians and law enforcement. Our findings suggest the relationship between law enforcement and civilians is central to the implementation of this policy, and more broadly, accountability.

This book tackles the growing issues concerning the managerialism and bureacratisation of criminal justice systems across a number of jurisdictions. Here, managerialism means the move towards more standardised, bureaucratic and efficiency-driven systems, influenced by a desire to ensure predictability, control risks and, ultimately, economic savings via a more efficient process.
