Requirements for the defendant to actively participate in the English criminal process have been increasing in recent years such that the defendant can now be penalised for their non-cooperation. This book explores the changes to the defendant’s role as a participant in the criminal process and the ramifications of penalising a defendant’s non-cooperation, particularly its effect on the adversarial system. The book develops a normative theory which proposes that the criminal process should operate as a mechanism for calling the state to account for its accusations and request for official condemnation and punishment of the accused. It goes on to examine the limitations placed on the privilege against self-incrimination, the curtailment of the right to silence, and the defendant’s duty to disclose the details of his or her case prior to trial. The book shows that, by placing participatory requirements on defendants and penalising them for their non-cooperation, a system of obligatory participation has developed. This development is the consequence of pursuing efficient fact-finding with little regard for principles of fairness or the rights of the defendant.

Baptists in Romania have developed a practice of suspicion when it comes to religious dialogue, especially with the Romanian Orthodox tradition, due to a history that is characterized by oppression. In this detailed study Dr Daniel Oprean paves the way for positive dialogue between the two traditions, highlighting that much can be gained and learned by acknowledging similarities and differences in key aspects of theology. Dr Oprean explores how existing theological resources can be used to enhance theological discourse between Baptist and Orthodox traditions in Romania through in-depth analysis of the thought of British Baptist theologian, Professor Paul Fiddes, and Romanian Orthodox theologian, Father Dumitru Stăniloae. Oprean in particular looks at their understanding of trinitarian and human participation through perichoresis, the Eucharist, Christian spirituality, and baptism and chrismation. Presented as a conversation between the two traditions this study is a model for how theological and religious dialogue can facilitate reconciliation, not just in the church but also in wider society.

The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. It brings distinct normative insights into a crucial theme of EU administrative law, and makes a topical and timely contribution to the increasingly notable theme of public participation in EU regulation. Processes and Foundations for Virtual Organizations contains selected articles from PRO-VE'03, the Fourth Working Conference on Virtual Enterprises, which was sponsored by the International Federation for Information Processing (IFIP) and held in Lugano, Switzerland in October 2003. This fourth edition includes a rich set of papers revealing the progress and achievements in the main current focus areas: -VO breeding environments; -Formation of collaborative networked organizations; -Ontologies and knowledge management; -Process models and interoperability; -Infrastructures; -Multi-agent approaches. In spite of many valid contributions in these areas, many research challenges remain.
