Although there has been a lot written about how counter-terrorism laws impact on human rights and civil liberties, most of this work has focussed on the most obvious or egregious kinds of human rights abrogation, such as extended detention, torture, and extraordinary rendition. Far less has been written about the complex ways in which Western governments have placed new and far-reaching limitations on freedom of speech in this context since 9/11. This book compares three liberal democracies - the United States, the United Kingdom and Australia, in particular showing the commonalities and similarities in what has occurred in each country, and the changes in the appropriate parameters of freedom of speech in the counter-terrorism context since 9/11, achieved both in policy change and the justification for that change. In all three countries much speech has been criminalized in ways that were considered anachronistic, or inappropriate, in comparable policy areas prior to 9/11. This is particularly interesting because other works have suggested that the United States' unique protection of freedom of speech in the First Amendment has prevented speech being limited in that country in ways that have been pursued in others. This book shows that this kind of argument misses the detail of the policy change that has occurred, and privileges a textual reading over a more comprehensive policy-based understanding of the changes that have occurred. The author argues that we are now living a new-normal for freedom of speech, within which restrictions on speech that once would have been considered aberrant, overreaching, and impermissible are now considered ordinary, necessary, and justified as long as they occur in the counter-terrorism context. This change is persistent, and it has far reaching implications for the future of this foundational freedom.

This innovative volume is focused on the relationship between religion on the one hand and political and judicial rights on the other. At a time when the so-called ‘checks and balances’ that guarantee the vulnerable equilibrium between legislative, executive and judicial branches of governance are increasingly under pressure, this book offers valuable insights. It presents empirical work that has measured young people’s attitudes and explains the variety found across their views. Readers will find answers to the question: To what extent do youths in different countries support political and judicial human rights and what influences their attitudes towards these rights? The political rights in this question include, among others, active and passive voting right, the right to protest, and the rights of refugees. Judicial rights refer in general to the right of a fair trial, and include principles like equality before the law; the right to independent and impartial judgement; the presumption of innocence; the right to legal counsel; and the privilege against self-incrimination. Expert contributing authors look at aspects such as religious beliefs and practices, personal evaluation of state authorities, and personality characteristics. The authors discuss contextual determinants for attitudes towards political and judicial rights, in both theory and empirical indicators. Numerous helpful tables and figures support the written word. This book makes an original contribution to research through the empirical clarification of factors that induce or reduce people’s support of political and judicial rights. It will appeal to graduates and researchers in religious studies, philosophy or sociology of religion, among other disciplines, but it will also interest the general reader who is concerned with matters of human rights and social justice.

Through a theoretical examination of the preventive turn in criminal law and justice which has gained momentum in Anglo-American criminal justice systems since the late-twentieth century, The Preventive Turn in Criminal Law demonstrates how recent transformations in criminal law and justice are intrinsically related to and embedded in the way liberal society and liberal law have been imagined, developed, and conditioned by its social, political, and historical context. Henrique Carvalho identifies a tension between the idea of punishment as an expression of individual justice, and prevention as a manifestation of the need for security and the promotion of welfare. Tracing this tension back to an intrinsic ambivalence within the modern conception of individual liberty, which is both repressed and preserved by liberal conceptions of responsibility and punishment, Carvalho proves that as long as this ambivalence remains unexamined, liberal law has the potential to both promote and undermine individual justice. Engaging with the dominant contemporary literature on criminal law, prevention, risk, security, and criminalisation, this volume deploys a theoretical perspective developed through a critical analysis of both classical and contemporary works of social and political theory. The book reveals that the pervasiveness of prevention in 21st century criminal justice systems represents not only the consequence of new and unprecedented features of contemporary politics and society, but also the manifestation of essential aspects of the liberal legal and political tradition.
