Combating Transnational Terrorism

Transnational terrorism is the central security challenge of the Post Cold War World, the defining moments of which were 9/11 in New York and 26/11 in Mumbai. Just as the United States carried out a comprehensive review of counter terrorism threats and capabilities immediately after the deadly multiple strikes in September 2001, India has undertaken an appraisal of transnational terrorism over the past two years and has commenced a process of transformation of the internal security establishment post Mumbai. Keeping in view the significance of the issue to Indian security, USI had undertaken a study focused on “National Security –Countering Transnational Terrorism,” this year, organizing a series of seminars, lectures and studies on the subject. This book is a result of the study carried out by USI and has covered the entire range of the phenomenon examining geo political, regional and internal security facets to suggest strategies for security cooperation, capacity building and societal responses.

Combating a Modern Hydra: Al Qaeda and the Global War on Terrorism is number eight in the Combat Studies Institute s Global War on Terrorism (GWOT) Occasional Paper series. This work resulted from discussions at Fort Leavenworth about the nature of the enemy facing the United States and its allies since 11 September 2001. Osama bin Laden and his terrorist network had been present at some level in the national and international consciousness since the late 1990s. The events of 11 September 2001 and subsequent global operations taken against Al Qaeda have brought this group to the forefront of the GWOT. While successes have been achieved in the GWOT, the enemy has proven to be resilient and adaptive. This study by Mr. Sean Kalic, of the Department of Military History, US Army Command and General Staff College, examines modern transnational terrorism from the 1960s to the present day, with special emphasis on the adaptation Al Qaeda and other nonstate actors have taken in response to the actions of the United States and its allies. This work provides a cautionary warning about the likelihood Al Qaeda will continue to survive and execute missions in the current operating environment. Mr. Kalic synthesizes much of the pertinent literature and offers insights into the actions taken to ght terrorists. Most importantly, he advises a continual reevaluation of the threat, based on Al Qaeda's exibility, resiliency, and adaptability. Of cers and soldiers who have recently served in operations against the terrorist worldwide will certainly see utility here. As the US Army continues its efforts in combating terrorists, the thoughts found in this narrative are well worth considering.

Transnational terrorism organized and inspired by Al Qaeda is a scourge of the early 21st century. It is essential that the international community should work together to eliminate it. The framework with which the U.S. government under President George W. Bush chose to confront it in the aftermath of the atrocities in New York and Washington, D.C., on September 11, 2001, was the Global War on Terror, or GWOT. This was an unfortunate choice as it directed the United States and other leading democratic countries to try to wage war against terrorism, a method, not an opponent. This put the United States and its allies on a mission that could not be accomplished, because method cannot be defeated in a war in the sense that an identifiable enemy can.

This book offers a unique and insightful econometric evaluation of the policies used to fight transnational terrorism between 1990 and 2014 using a sample of 124 countries. It proves that foreign aid plays a crucial role by inducing recipient governments to protect the donors’ political and economic interests within their sphere of influence. In contrast, US troops on the ground are counter-productive as they increase the supply of terrorist attacks from the host countries, even though this effect has been significantly reduced by the Obama administration.

The involvement of insurgent and extremist groups in criminal activity is an issue that has been a concern of U.S. administrations for decades. In recent years, some observers have claimed that interactions between international terrorists and criminals are increasing. If true, expanded links between criminal and terrorist networks could increase U.S. vulnerability to attack by terrorist groups with enhanced criminal capabilities and financial resources. An expanded range of combined criminal and terrorist activity could also affect the global economy and U.S. foreign policy goals, undermining licit international commerce and the promotion of good governance and rule of law. Threats posed by a crime-terrorism nexus may be particularly challenging, as the scale and nature of their cooperation are believed to vary widely and limited anecdotal evidence largely serves as the basis for current understanding of the problem. U.S. efforts to combat the relationship between crime and terrorism are a subset of broader policy responses to transnational crime and international terrorism individually. While numerous U.S. strategies and programs are designed to combat international terrorism and transnational crime separately, fewer efforts focus specifically on addressing the confluence of the two. Those efforts that do exist focus mainly on (1) human smuggling and clandestine terrorist travel, (2) money laundering and terrorist financing, and (3) narcoterrorism links between drug traffickers and terrorists. Many of these efforts, including the creation of the Human Smuggling and Trafficking Center, the reorganization of the Treasury Departments Office of Terrorism and Financial Intelligence, and the expanded extraterritorial jurisdiction authority to investigate and prosecute international narcoterrorism cases, occurred in response to the attacks of September 11, 2001. Congress played a large role in such efforts, holding at least eight hearings specifically on some aspect of c.

Every State has an obligation to prevent terrorist attacks emanating from its territory. This proposition stems from various multilateral agreements and UN Security Council resolutions. This study exhaustively addresses the scope of this obligation of prevention and the legal consequences flowing from its violation, so as to provide greater clarity on governments' counterterrorism duties and to enhance State accountability for preventable wrongs. It defines the contents and contours of the obligation while placing critical emphasis on the mechanics of State responsibility. Whether obscured by new technologies like the Internet, the sophisticated cellular structure of some terrorist organisations or convoluted political realities, the level of governmental involvement in terrorist activities is no longer readily discernible in every instance. Furthermore, the prospect of governments waging surrogate warfare through proxies also poses intractable challenges to the mechanism of attribution in the context of State responsibility. This monograph sets out the shortcomings of the extant scheme of State responsibility while identifying a paradigm shift towards more indirect modes of accountability under international law, a trend corroborated by recent State and institutional practice. Drawing on varied legal and theoretical influences, the study devises and prescriptively argues for the implementation of a strict liability-inspired model grounded in the logic of indirect responsibility with a view to enhancing State compliance with counterterrorism obligations. This shifts the policy focus squarely to prevention, while promoting multilateralism and transnational cooperation. Ultimately, the legal and policy sensibilities underlying the book converge into a new theory of prevention in counterterrorism contexts. A unique survey and assessment of counterterrorism strategies across the globe by prominent experts

The dramatic terrorist attacks of 9/11 highlighted significant gaps in research on the topic as governments, community groups, social service agencies and law enforcement agencies were forced to respond without any evidence-based guidance on best practices for tactics, strategies, and policy development. The essays selected for this volume demonstrate that transnational terrorism is now a thriving area of study and display the breadth and depth of scholarship that has recently been published. The research draws attention to global patterns of transnational terrorism; highlights various structural and cultural explanations; provides an overview of some of the ways that terrorism impacts society; and discusses strategies used to effectively respond to transnational terrorism. This volume, which is of interest to academics, policymakers and practitioners, provides a repository of some of the best contemporary research in this field.
