The impact of colonial dispossession and the subsequent social and political ramifications places a unique burden on governments having to establish equitable means of addressing previous injustices. This book considers the efforts by both Canada and South Africa to reconcile the damage left by colonial expansion, in part, looking back with a critical eye, but also pointing the way towards a solution that will satisfy the common need for human dignity

This innovative and interdisciplinary book makes a major contribution to common pool resource studies. It offers a new perspective on the sustainable governance of common resources, grounded in contemporary and archival research on the common lands of England and Wales - an important common resource with multiple, and often conflicting, uses. It encompasses ecologically sensitive environments and landscapes, is an important agricultural resource and provides public access to the countryside for recreation. Contested Common Land brings together historical and contemporary legal scholarship to examine the environmental governance of common land from c.1600 to the present day. It uses four case studies to illustrate the challenges presented by the sustainable management of common property from an interdisciplinary perspective - from the Lake District, Yorkshire Dales, North Norfolk coast and the Cambrian Mountains. These demonstrate that cultural assumptions concerning the value of common land have changed across the centuries, with profound consequences for the law, land management, the legal expression of concepts of common 'property' rights and their exercise. The 'stakeholders' of today are the inheritors of this complex cultural legacy, and must negotiate diverse and sometimes conflicting objectives in their pursuit of a potentially unifying goal: a secure and sustainable future for the commons. The book also has considerable contemporary relevance, providing a timely contribution to discussion of strategies for the implementation of the Commons Act of 2006. The case studies position the new legislation in England and Wales within the wider context of institutional scholarship on the governance principles for successful common pool resource management, and the rejection of the 'tragedy of the commons'.

The first authoritative survey of the history of common land in Great Britain from the medieval period to present day.

Recent revisionist history has questioned the degree of social and economic change attributable to the French Revolution. Some historians have also claimed that the Revolution was primarily an urban affair with little relevance to the rural masses. This book tests these ideas by examining the Revolutionary, Napoleonic and Restoration attempts to transform the tenure of communal land in one region of southern France; the department of the Gard. By analysing the results of the legislative attempts to privatize common land, this study highlights how the Revolution's agrarian policy profoundly affected French rural society and the economy. Not only did some members of the rural community, mainly small-holding peasants, increase their land holdings, but certain sectors of agriculture were also transformed; these findings shed light on the growth in viticulture in the south of France before the monocultural revolution of the 1850s. The privatization of common land, alongside the abolition of feudalism and the transformation of judicial institutions, were key aspects of the Revolution in the countryside. This detailed study demonstrates that the legislative process was not a top-down procedure, but an interaction between a state and its citizens. It is an important contribution to the new social history of the French Revolution and will appeal to economic and social historians, as well as historical geographers.

An examination of the treatment of common land in the work of English painters, at a time when much of it was to disappear forever. A most elegantly written book that calmly knocked many entrenched but erroneous notions about British landscape painting firmly on the head. Longlisted and commended by the judges of the 2013 William M. B. Berger prize forBritish art history. During the eighteenth and nineteenth centuries, much of England's common land was eradicated by the processes of parliamentary enclosure. However, despite the fact that the landscape was frequentlyviewed as unproductive, outmoded and unsightly, many British landscape painters of the time - including Constable, Gainsborough and Turner - resolutely continued to depict it. This book is the first full study of how they did so, using evidence drawn not only from art-historical picture analysis, but from contemporary poems and novels, and the contemporary pamphlets, essays and reports that advanced the rhetoric of both agricultural improvement and new theories on landscape aesthetics. It highlights a deep-rooted social and cultural attachment to the common field landscape, and demonstrates that common land played a significant but - until now - underestimated role in both the history of English art and of the formation of an English national identity, reflecting what are still highly sensitive issues of progress, nostalgia and loss within the English countryside. Recasting common land as a recurrentfacet of English culture in the modern period, the numerous paintings, drawings and prints featured in this book give the reader a comprehensive and evocative sense of what this now almost wholly lost landscape looked like in itshey-day. Common pool resources provide important socioeconomic and ecological benefits for local communities and beyond, with around 2.5-3 billion people depending on commons for their livelihoods and other needs globally. In India, common lands constitute around a quarter of the country’s landmass, help meet the subsistence and livelihood needs of at least 350 million people and are of social and cultural significance to rural communities, as well as providing ecosystem services that benefit wider society. Despite these vital contributions, India’s commons have been facing widespread degradation, and policymakers tend to perceive some commons as “wastelands” because their true extent and value is not known. This study contributes to improved understanding of the magnitude and vitality of commons for rural communities, focusing on land-based commons in India. We provide a national assessment of the spatial extent and usage of common lands across districts, using publicly available spatial datasets and 2011 Census of India data and Household Census data. We further examine the spatial overlap between common lands and officially recognized protected areas to shine light on the possible locations where sustainable management or restoration of commons can potentially add value to conservation, in addition to benefiting local communities. Our results show that common lands are spread out spatially across the country and are intertwined, with more than one type of commons often present within the same district. Further, communities, especially poor, marginalized and indigenous communities such as Scheduled Tribe rely on forest commons, barren lands, pastures and culturable wastelands for their livelihoods, including for extraction of non-timber forest products (NTFPs) for housing and cooking, grazing livestock, among others. Common lands and the communities that depend on them also often live in proximity to or are surrounded by officially recognized protected areas. Our study points to the need to drill down to more disaggregated level for commons mapping, which, in conjunction with information on the values of ecosystem services provide by commons, could inform land use policies and conservation and development planning.
