This book considers the increasing trend towards a âe~culture of controlâe(tm) in democratic countries. The post-9/11 counter-terrorism laws in nations such as the USA, the UK, Canada and Australia provide a stark demonstration of this trend. These laws share a focus on the pre-emption of crime, restrictions on the right to liberty of non-suspects, limited public access to information, and increased community surveillance. The laws derogate, in many respects, from the ordinary principles of the criminal justice system and fundamental human rights while also harnessing public institutions in the broader project of prevention and control. Distinctively, the contributors to this volume focus on the impact of these laws outside of the counter-terrorism context. The book draws together a range of experts in both public and criminal law, from Australia and overseas, to examine the effect of counter-terrorism laws on public institutions within democracies more broadly. This book contributes to the understanding of the counter-terrorism (CT) policy of the European Union (EU) by offering a set of analyses focusing on its external dimension. Whilst calling for the combination of internal and external policies as well as cooperation with third countries and international institutions, the external dimension of EUCT challenges previous assumptions on the functioning of the EU and offers new testing ground for the latest theoretical and methodological approaches. This volume provides the first systematic assessment of the external dimension of EUCT. It covers transatlantic counter-terrorism cooperation, the interaction between EU institutions and policies, theoretical debates on EU actorness in counter-terrorism and the role of judicial institutions in international counter-terrorism. Furthermore, it draws attention to the need for engaging in new discussions over the post-Lisbon Treaty Common Foreign and Security Policy (CFSP), the international fight against terrorism, and the way international actors cooperate and compete on the security arena. The 9/11 attacks revealed that the transnational terrorist threat facing the US and its partners was far more dangerous than most had previously discerned. It was now clear that al-Qaeda intended to, and could threaten the West’s – particularly the US’ – political and military leverage, with the aim of shifting the balance of power from the West to Islam after a violent global confrontation. In that sense, the new terrorist threat is strategic, and it has led to a worldwide mobilisation comparable to that required by a world war. This Paper argues that prevailing in the ‘war’ on terror, much like victory in the Cold War, entails containment, deterrence, outperformance and engagement. Military power is secondary to intelligence, law enforcement, enlightened social policy and diplomacy. Diplomatic engagement with the larger Muslim world is paramount as a means of denying al-Qaeda not merely recruits but the‘clash of civilisations’ it seeks. The US-led intervention in Iraq, though intended to introduce democratic reform in the wider Middle East, has so far antagonised Islam and strengthened Islamist terrorism. This suggests that coercive or aggressively ideological diplomacy is unlikely to win over an Islamic population biased by anti-Western propaganda. Successful Western diplomacy will have to be discreet, nuanced and incremental.
