Democracy, Agency, and the State aims to contribute to a comparatively informed theory of democracy. Professor O'Donnell begins by arguing that conceptions of 'the state' and 'democracy', and their respective defining features, significantly influence each other. Using an approach that is both historical and analytical, he traces this relationship through the idea of legally sanctioned and backed agency which grounds democratic citizenship. From this standpoint he explores several aspects of the democratic regime and of the state, distinguishing four constitutive dimensions (bureaucracy, legality, focus of collective identity, and filter). He goes on to examine the role played by the idea of 'the nation' or 'the people', and the ways in which the state represents itself to different sections of society, especially in countries marred by deep inequality and pervasive poverty. Drawing on the examples of democratic and non-democratic regime, he discusses the dialogical spaces congenial to democracy, as well as examining the options that may or may not enable agency, and the complex comparative and ethical issues raised by the intersection of agency with globalization and legal pluralism.Throughout these discussions several comparative vistas are opened, especially but not exclusively toward Latin America. The book concludes by offering a justification of democracy, even of the flawed democracies that nowadays abound. In 1996, Guillermo O’Donnell taught a seminar at the University of Notre Dame on democratic theory. One of the questions explored in this class was whether it is possible to define and determine the “quality” of democracy. Jorge Vargas Cullell, a student in this course, returned to his native country of Costa Rica, formed a small research team, and secured funding for undertaking a “citizen audit” of the quality of democracy in Costa Rica. This pathbreaking volume contains O’Donnell’s qualitative theoretical study of the quality of democracy and Vargas Cullell’s description and analysis of the empirical data he gathered on the quality of democracy in Costa Rica. It also includes twelve short, scholarly reflections on the O’Donnell and Cullell essays. The primary goal of this collection is to present the rationale and methodology for implementing a citizen audit of democracy. This book is an expression of a growing concern among policy experts and academics that the recent emergence of numerous democratic regimes, particularly in Latin America, cannot conceal the sobering fact that the efficacy and impact of these new governments vary widely. In this book Robert Brulle draws on a broad range of empirical and theoretical research to investigate the effectiveness of U.S. environmental groups. Brulle shows how Critical Theory--in particular the work of Jürgen Habermas--can expand our understanding of the social causes of environmental degradation and the political actions necessary to deal with it. He then develops both a pragmatic and a moral argument for broad-based democratization of society as a prerequisite to the achievement of ecological sustainability. From the perspectives of frame analysis, resource mobilization, and historical sociology, using data on more than one hundred environmental groups, Brulle examines the core beliefs, structures, funding, and political practices of a wide variety of environmental organizations. He identifies the social processes that foster the development of a democratic environmental movement and those that hinder it. He concludes with suggestions for how environmental groups can make their organizational practices more democratic and politically effective.

The concept of constituent power plays a major part in modern political and legal theory— in how we think about the political. This book tackles the twofold issue of public authority and public autonomy in the modern conception of the political by analysing the notion of constituent power, its function in the modern political apparatus, and debates about its meaning and function in our own context. Focusing on contemporary debates on constitutionalism "beyond" the state, Geneviève Nootens assesses the prospects for recasting the notion of constituent power in a polycentric setting that challenges state sovereignty as embodying the autonomy of the political. She argues that constituent power belongs with the conceptual apparatus of a theory of government peculiar to a statist way of knowing, and being into, the world, and that it is too much dependent upon the statist framework for it to have critical purchase on the new mappings of public authority. Nootens stresses the critical need to frame public authority appropriately if we are to conceptualize a conception of collective political agency that can sustain public autonomy in the current era.
