Excerpt from Elements of American Jurisprudence Jurisprudence, as the word is used in the title of this book, denotes the science of which law, as such, is the subject-matter; the science which deals, not with the commands and prohibitions whereof the law consists, but with the law itself, its nature, its origin, its history, its divisions, its forms, its interpretation, and the methods of its application to practical affairs. Of law in general, considered as an essential feature of political society and abstracted from all definite systems of law, there is a universal science known as General Jurisprudence; and of every system of law, differing as each does from every other in some of its exterior characteristics, there is a special science, - the Particular Jurisprudence of the State in which that law prevails. Thus American Jurisprudence is a special science, treating of the laws of the United States and of the States of which the American Union is composed. Manifestly some knowledge of this science is important to every educated citizen who aspires to the intelligent discharge of his political duties; a more intimate acquaintance with it is indispensable to the lawyer and the judge who participate in the interpretation and administration of the law; while for the jurist and the legislator the mastery over it must be still broader and more profound. In the present work it has been the purpose of the author to assist the various grades of students in their preparation for these different positions in political life. Excerpt from Introduction to American Law But I have entitled this book, an Introduction to American Law, and I may be called upon to vindicate the propriety of this title. I confess then, that in some minor respects, it may not be equally adapted to all parts of the Union; but my excuse is, that without being ten times as large as it is, 'it could not have been made so. If I had possessed the knowledge, I could not, within any reasonable compass, have referred to the local law of twenty-six different states; and yet local references were occasionally necessary, in order to exhibit an entire system. I was compelled, therefore, in such cases, to make choice of some particular state; and I naturally selected that state in which the lectures were read. But these local references, in an out line so general as this, are not so frequent as to detract materially from the general adaptation of the book, to students in other states; and in case of diversity, the necessary corrections can be easily made. At all events, the diversity is less between the different states, than between any one state and England; and therefore something is cer tainly gained even on the score of general adaptation. And here let me anticipate an objection of another sort. It may be said, that in attempting to teach what the law is, I have dwelt too much upon what I think it should be; or, in other words, that in a work professedly didactic, I have speculated too much upon projects of reform. To this objection I have two answers. In the first place, I have never undertaken to show what the law ought to be, without first stating what it is. While therefore the primary end of instruo tion is obtained, the mind of the student is at the same time excited to compare, examine and discuss the principles in question; and thus impress them the more deeply upon his memory. And in the second place, if the suggestions I have ventured to make be sound, they can not be made too early, because bad laws are the very worst of bad things; and if these suggestions be not sound, they can do no harm, because the antidote accompanies the bane; nay the provision com plained of will inspire increased confidence in the mind of the student from having been unsuccessfully assailed. Excerpt from Elements of International Law Mr. Wheaton, after receiving the ordinary preliminary in struction, graduated at the College of his native State, now Brown University, in 1802. During the ensuing three years he prepared himself, in the office of Nathaniel Searle, then among the prominent practitioners at Providence, for admission to the bar. His studies were, from his earliest days, of a cha reeter appropriate to the education of a publicist. Besides his proficiency in the classical and mathematical departments, he was particularly distinguished, at school and college, for his fondness for general literature, and especially for historical research and the investigation of the political annals of nations. In the spring of 1805, he went to Europe, and though his desire for intellectual improvement and his sound moral prin ciples would, probably, have proved an adequate protection against all improper temptations, it was, perhaps, well for his future success that his father's moderate views of expense did not permit him, at once, to luxuriate in a great metropolis. He established himself at Poitiers, where there was a school of law. His object seems to have been to acquire a familiarity with the use of the French language, in which he had been early instructed; while he availed himself of the Opportunity to frequent the tribunals and study the civil law. Indeed, in this branch of jurisprudence, Mr. Vvheaton might almost be deemed a pioneer among his countrymen. Even Pothier, whose works contributed so largely to the Napoleon Code, had not then been made accessible to the American lawyer. Nor had Kent and Story, whose decisions derive so much value from their abundant stores of continental lore, and both of whom had repeated occasion to appreciate the early studies of Mr. Wheaton, then assumed their places in the tribunals, which they subsequently illustrated - the one as Chancellor of New York, the other as a member of the Supreme Federal Judi Clary.
