Enacting An Improved Response To Sexual Assault

Sexual assault is a violent crime that traumatizes individual victims and endangers entire communities. Every victim of sexual assault deserves an opportunity for justice and access to the resources they need to recover from this trauma. In addition, many perpetrators of sexual assaults are serial offenders who also commit other violent crimes, including armed robberies, aggravated assaults, burglary, domestic violence, and homicides, against strangers and acquaintances. Criminal justice agencies have the power to create a strategic, sustainable plan for an improved response to sexual assault that aligns with current best practices and national recommendations. In this document, we define an "improved response" as an approach that supports effective investigation and prosecution of sexual assault cases, holds perpetrators accountable, and promotes healing and recovery for victims of sexual assault. This guide will help prosecutor and law enforcement agencies create a process with milestones, goals, and suggested actions, all designed to support a successful and sustainable approach for addressing sexual assault cases. Improving the criminal justice system's response to sexual assault ultimately improves public safety and promotes trust between criminal justice agencies and the communities they serve.

Sexual Assault Kits and Reforming the Response to Rape curates the current state of untested sexual assault kit research and highlights emerging best practices by exploring the past, the present, and the future of our collective response to rape. This book is the first to address the most critical topics related to untested sexual assault kits and the Department of Justice’s Sexual Assault Kit Initiative, bringing together leading US scholars, practitioners, policy makers, and survivors. In a series of well-researched and thoughtful thematic chapters, the book explores the current state of knowledge related to untested kits, survivors, and perpetrators, while also documenting fundamental and necessary changes in how societal systems respond to rape. It provides an opportunity to learn from our past, highlight what we could do differently now, and envision a better future for victims of rape and those tasked with ensuring justice. It may also serve as a cautionary tale for those jurisdictions that have yet to face their backlog or who have failed to embrace the practice and policy changes that have emerged from the Sexual Assault Kit Initiative. "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. This book was created to celebrate the tenth anniversary of Jane Doe’s remarkable legal victory against the Toronto police for sex discrimination in the policing of rape and for negligence in failing to warn her of a serial rapist. The case made legal history and motivated a new generation of feminist activists. This book honours her pioneering work by reflecting on how law, legal practice and activism have evolved over the past decade and where feminist research and reform should lead in the years to come.
