Excerpt: ...duty--e.g., compulsory pilotage--or (c) the doctrine that no one shall enrich himself unjustly at another's expense--e.g., the liability of infants for necessaries; (3) tort, i.e., a civil wrong not arising out of contract; or (4) quasi-tort, i.e., a term used by certain text-book writers for convenience of classification, under which head is included cases in which third parties, themselves innocent of any wrongful act or omission, are nevertheless held liable for such acts when committed by their servants in the course of their employment. Liabilities may be joint or several, or joint and several. In Contract.--Where the liability be joint, each defendant is personally responsible for the whole liability, but all defendants may be sued. Where the liability is joint and several one or more may be sued, and judgment against one, if unsatisfied, is no bar to an action against the others. Where the liability is several, any or all the parties may be joined as co-defendants, or, if dead, their executors or administrators. One defendant who pays the whole or more than his share can claim contribution from the others.
