Fao And Marine Biological Diversity Beyond National Jurisdiction Bbnj Process

FAO is actively engaged in areas beyond national jurisdiction (ABNJ) through projects and initiatives for which it provides assistance to Member Nations and relevant international organizations. This document presents information on the work of FAO that is relevant to the BBNJ process, including ongoing processes and initiatives, and lessons learned, which may be informative and useful for BBNJ Delegates and others. This information may also be a useful indication of areas where FAO may assist Member Nations in the implementation of the future international legally binding instrument (ILBI).

Recognizing the need for control, this report focuses on international obligations regarding deep-sea fisheries and biodiversity conservation, and discusses provisions that require national-level implementation. It analyses policy and legal instruments, and identifies implementation challenges.

This step-wise guide aims to assist with the implementation of relevant international instruments pertaining to deep-sea fisheries and biodiversity conservation in areas beyond national jurisdiction, especially the high seas, into national policy and law. This guide focuses on the incorporation and transposition of international rules, standards, and recommended practices and procedures into national policy and law. It addresses the key measures for making international obligations effective at the national level and suggests possible options for integrating those measures into the national legal framework. Legislative examples are also provided to illustrate how certain provisions have been incorporated into primary or secondary legislation. The guide first addresses the establishment of a national policy, followed by a description and analysis of essential legislative provisions regarding deep-sea fisheries and the conservation of marine biological diversity in areas beyond national jurisdiction. This guide is thus relevant to policy-makers, parliamentary draftpersons, and parliamentarians.

The Thirty-fifth Session of the Committee on Fisheries (COFI) was held in Rome, Italy, from 5 to 9 September 2022. This is a report of the Session reflecting the discussions which took place and containing all recommendations and decisions taken by the Committee. A synopsis of the outcome of the Session is presented in the abstract and all supplementary information is included in the appendixes.

Marine Biodiversity of Areas beyond National Jurisdiction (BBNJ) identifies the major issues at stake in the BBNJ negotiations and examines the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction. This timely volume offers cutting edge contributions from leading global experts on access and benefit sharing of marine genetic resources; environmental impact assessments; capacity building and transfer of technology as well as Arctic environmental issues including security and shipping. Cross-cutting themes including the potential impact on existing legal frameworks and instruments are also explored.

This book investigates competing constructions of areas beyond national jurisdiction, and their role in the creation and articulations of legal principles, providing a broader perspective on the ongoing negotiation at the UN on marine biodiversity beyond national jurisdiction.

The Ninth Meeting of the Regional Fishery Body Secretariats’ Network (RSN-9) brought together Secretariats of regional fishery bodies (RFBs) with diverse mandates from all geographic regions, including FAO and non-FAO regional fishery bodies, marine and inland fishery advisory and management bodies and agreements, the United Nations Division for Ocean Affairs and the Law of the Sea (DOALOS), the Convention on Biological Diversity (CBD), the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), the United Nations Environment Programme (UNEP) and other invited organizations. RSN-9 took place immediately before and after the Thirty-fifth Session of the Committee on Fisheries (COFI-35), which was held from 5 to 9 September 2022. As was the case with COFI, RSN-9 met in hybrid format, in person and virtually, via videoconference, to facilitate the participation of those who could not assist personally. For the first time, the meeting was convened over three days. The meeting allowed participants to exchange views and discuss global processes of particular relevance to RFBs. In addition, RSN-9 provided the opportunity to discuss the development and strengthening of RSN, which included the adoption of the RSN terms of reference and the subsequent amendment of the RSN rules of procedure, as well as a space for reflection on the outcomes of COFI 35 and their implications for regional fishery bodies. The meeting had a high level of participation, which underlined the role of the Network as a unique forum to foster cooperation, facilitate discussion and share experiences.
