Fathers of Conscience examines high-court decisions in the antebellum South that involved wills in which white male planters bequeathed property, freedom, or both to women of color and their mixed-race children. These men, whose wills were contested by their white relatives, had used trusts and estates law to give their slave partners and children official recognition and thus circumvent the law of slavery. The will contests that followed determined whether that elevated status would be approved or denied by courts of law. Bernie D. Jones argues that these will contests indicated a struggle within the elite over race, gender, and class issues--over questions of social mores and who was truly family. Judges thus acted as umpires after a man's death, deciding whether to permit his attempts to provide for his slave partner and family. Her analysis of these differing judicial opinions on inheritance rights for slave partners makes an important contribution to the literature on the law of slavery in the United States.

In Western countries conscientious objection is usually accommodated in various ways, at least in certain areas (military conscription, medicine) and to some extent. It appears to be regarded as fundamentally different from other kinds of objection. But why? This study argues that conscientious objection cannot be understood as long as conscience is misunderstood. The author provides a new interpretation of the historical development of expressions of conscience and thought on the subject, and offers a new approach to conscientious objection rooted in the symbol-approach to conscience.

It was the helpless, pathetic, strange cry of a Dumpster baby and growling of some creatures that drew the attention of passersby. .., An unknown mother had intentionally wrapped her baby securely and placed him in an iron cage - ...with a note boldly written, "Take care of my baby." With the top of the cage properly covered from rain and sun, she placed the cage where the prowling eyes of Government waste disposal scavengers would see it. At least the unknown mother still had a mother's bowel of mercy and protective milk of compassion. But unfortunately, the wrong guys, the reptiles got there first. In Western thought, it has been persistently assumed that in moral and political matters, people should rely on the inner voice of conscience rather than on external authorities, laws, and regulations. This volume investigates this concept, examining the development of the Western politics of conscience, from Socrates to the present, and the formation of the Western ethico-political subject. The work opens with a discussion of the ambiguous role of conscience in politics, contesting the claim that it is the best defense against totalitarianism. It then look back at canonical authors, from the Church Fathers and Luther to Rousseau and Derrida, to show how the experience of conscience constitutes the foundation of Western ethics and politics. This unique work not only synthesizes philosophical and political insights, but also pays attention to political theology to provide a compelling and innovative argument that the experience of conscience has always been at the core of the political Western tradition. An engaging and accessible text, it will appeal to political theorists and philosophers as well as theologians and those interested in the critique of the Western civilization.
