The free movement of persons and services are key elements, alongside the free movement of goods and capital, in the fundamental freedoms which underpin the European internal market. In recent years two key themes have emerged from the case law of the European Court of Justice. The first is convergence in the case law on the free movement of goods, persons, and services in order to ensure the operation of the internal market through the prohibition of discrimination and the outlawing of unjustified obstacles to free movement. The second is the case law on the rights which flow from the introduction of citizenship of the European Union, which offer constitutional rights for individuals. The tensions between these two lines of authority can be explained through a fresh approach to the analysis and synthesis of the Treaty rules and secondary legislation of the European Community, and of the case law of the European Court of Justice on free movement of persons and services. This approach is based on distinguishing between those rules which relate mainly to the regulation of business activities in the internal market, and those which are mainly concerned with individual rights for citizens of the European Union. The result is a detailed overview of the law relating to workers, establishment, and services in the EU in this modern context.

Document from the year 2014 in the subject Politics - International Politics - Topic: European Union, grade: 2,0, , language: English, abstract: In 1992 the European Union established a huge European Single Market, which includes its 28 Member States as well as Liechtenstein, Iceland, Norway and Switzerland. It contains four freedoms that guarantee free movements of goods, services, capital and people. With a possession of 4.325 Mio. km2 and 493 Mio. citizens it is one of the biggest internal markets on earth. Due to the omitted border formalities people are free to choose their place of residence, university and work place. But also the increasing quantity of goods followed by much more competition on the market in the EU leads to a price advantage for the consumers and therefore to a competitive position on the international market. Furthermore, the European Union framed some rules and additives to regulate the domestic market, like the implementation of a single currency in year 2001. In addition particular minimum standards, common standards for the environment, energy political measures, arrangements for consumer protection, a common transport policy, research funding as well as a solidary contribution for less developed Member States exist or are in process in the new regions which now belong to the EU. But there is still plenty of room for improvement with regard to the implementation of these regulations. Actually critics suppose that the transformation of normal markets in different countries into an internal market for all countries is a dubious method with incidental negative ancillary effects with unpredictable extents for the future. On account of this, the Research Paper primarily implies an explanation of the four freedoms of the European Union’s Single Market considerably. Secondly the main advantages as well as the disadvantages of the internal European trade are carved out and analysed.

In a period when the nature and scope of the European internal market is hotly contested, this collection offers a topical analysis of the most pressing issues relating to market integration and public services in the EU. As the debate continues over the balance between state control and market freedom, questions are also raised about the relationship between EU regulation and national policy choices and the 'joint responsibility' of the Union and the Member States. Outlining the most important current issues relating to market integration and public services in the EU, this book also addresses the underlying, systemic questions of the relation between public services and markets, and services and the consumer. Chapters also examine the application of state aids and procurement law to public services. The final two chapters focus on two public service sectors where the mix of Treaty rules, case law, and legislation has operated in rather different ways: public service media and health services

The Court of Justice of the European Union continues to deliver a great many important judgments which contribute to the rapid development of EU law. However, it can be difficult to understand the significance of many of these judgments unless they are accompanied by explanatory commentaries. This book contains over one hundred important cases on the topics of freedom of movement of goods, services, persons, and capital. All these cases are accompanied by comments and questions, so the reader is encouraged to reflect in more depth about each of the judgments and their effects. The cases, commentaries, and questions have been compiled for use in connection with courses studying the rules of the internal market, but they are recommended reading for all those who are interested in obtaining insight into the Court's practice in relation to the four fundamental freedoms of the Treaty on the Functioning of the European Union. "It is definitely a valuable book: it trains the analytical skills, gives a comprehensive view of the law and equips the reader very well for structuring and arguing a problem question within the field of free movement."--from the review of the first edition in European Law Review, 2005 [Subject: EU?Law]
