Il Diritto Nella Societ Digitale

The book starts with an analysis of what is new in the Digital Services Act. The aim is to see whether this new Regulation is appropriate both for not halting technological innovation and for addressing the risks that technological innovation poses to society and to the people who use digital services. The focal point is the risk of discrimination as people are often helpless in the face of the potential discriminations in the digital services sector. In particular, the book analyses how the Digital Services Act can make a concrete contribution to the protection against discrimination. To this end, it focuses on the responsibility of digital service providers and the fact that discrimination may also depend on the way in which algorithms and artificial intelligence systems are used. Therefore, a comparison is made between the Digital Services Act and the proposed Artificial Intelligence Act. The comparison discloses that the risk-based approach is the common thread followed by the EU in regulating the digital market. The book elaborates also on the practical implications of the risk-based approach. Highlighting advantages and limitations leading the author to conclude that the risk-based approach is the way forward only if the differences between risk and danger, the limits of law, and the limits of the tendency to humanise artificial intelligence systems are considered. With specific reference to the risk of discrimination, the need for a systemic and multi-level approach is highlighted, which reinforces the contribution that can be made not only by the Digital Services Act, but also by more general and cross-cutting legislation as those on data protection and unfair commercial practices.

L’intensificazione del rapporto tra tecnologia e diritto traccia nuove declinazioni della ‘normatività’, sollecitando una riflessione sul ruolo dell’essere umano nell’istituzione di una disciplina giuridica, anche nella società digitale. La formazione di una legalità giusta non è un processo automatico che può essere affidato all’automazione delle macchine intelligenti, prive del pensiero e della volontà, necessarie alla selezione di contenuti qualitativi. Solo in una direzione che custodisca la specificità dell’essere umano, come artefice dell’istituzione di una disciplina giuridica, il diritto rimane uno strumento al servizio del bene comune, non coincidendo fattualmente con le prassi-aspettative dei signori della rete.

These two volumes collect twenty five articles and papers published within the “Governance of/through Data” research project financed by the Italian Ministry of Universities. The research project, which was promoted by Roma Tre University, as project lead, and saw the participation of professors and reseachers from Bocconi University in Milan; LUMSA University in Rome; Salento University in Lecce and Turin Polytechnic, cover multiple issues which are here presented in five sections: Algorithms and artificial intelligence; Antitrust, artificial intelligence and data; Big Data; Data governance; Data protection and privacy.

This book analyses emerging constitutional principles addressing the regulation of the internet at both the national and the supranational level. These principles have arisen from cases involving the protection of fundamental rights. This is the reason why the book explores the topic thorough the lens of constitutional adjudication, developing an analysis of Courts’ argumentation. The volume examines the gradual consolidation of a "constitutional core" of internet law at the supranational level. It addresses the European Court of Human Rights and the Court of Justice of the European Union case law, before going on to explore Constitutional or Supreme Courts’ decisions in individual jurisdictions in Europe and the US. The contributions to the volume discuss the possibility of the "constitutionalization" of internet law, calling into question the thesis of the so-called anarchic nature of the internet.

Nel contesto in rapida evoluzione della società digitale, la regolazione europea emerge come un riferimento essenziale per studiosi ed operatori del diritto. Il Volume contiene analisi puntuali di Regolamenti e Direttive adottati dall’UE, nel corso degli ultimi tre anni (Data Governance Act e Data Act, NIS 1 e NIS 2, Digital Service Act e Digital Market Act), in attuazione del cd. Decennio Digitale Europeo 2020-2030 così come di alcuni temi trasversali, quali quello delle fonti del diritto utilizzate per la disciplina della società digitale, quello dell’approccio risk-based e quello dell’evoluzione delle Autorità indipendenti e di governo. Gli Autori mettono in luce che le normative oggetto di indagine vogliono contribuire, sulla scia del GDPR ed con l’IA ACT sullo sfondo, a definire un modello europeo di società digitale capace di perseguire contemporaneamente due obiettivi: quello essenziale di garantire l’esistenza del mercato unico digitale, e quindi un futuro all’UE; e quello politico di rappresentare una fonte di ispirazione e una guida per altri soggetti che debbano disciplinare il trattamento dei dati nella società digitale e garantire i diritti fondamentali online. Questo libro si propone, quindi, come una guida affidabile per coloro che cercano di comprendere la complessa rete normativa che regola il trattamento dei dati nell’attuale realtà europea. Inoltre, gli Autori sono tutti titolari di corsi universitari in materia di trattamento dei dati nella società digitale e, quindi, i saggi qui raccolti hanno anche una dichiarata finalità formativa.
