Land Claims In East Timor

Exploration of the issues surrounding resettlement of the East Timorese population since independence. Effectively having a 'clean slate' to establish ownership laws and institutions to regulate land ownership and use, the new East Timorese government must seek to balance the peace, security and economy of its people. The task of land claims in East Timor is unusually complex and difficult. This article, therefore, simply attempts a preliminary assessment. It does not seek to provide answers or recommendations as such, but rather a basic chronology of events, and typology of current and future land claims. The picture will be incomplete, and a primary purpose will be to indicate what further information is required. Nevertheless, it is hoped that the information provided will be enough to begin debate, particularly in the Australian legal profession, on means of assistance and appropriate ways forward.

Peace-building in a number of contemporary contexts involves fragile states, influential customary systems and histories of land conflict arising from mass population displacement. This book is a timely response to the increased international focus on peace-building problems arising from population displacement and post-conflict state fragility. It considers the relationship between property and resilient customary systems in conflict-affected East Timor. The chapters include micro-studies of customary land and population displacement during the periods of Portuguese colonization and Indonesian military occupation. There is also analysis of the development of laws relating to customary land in independent East Timor (Timor Leste). The book fills a gap in socio-legal literature on property, custom and peace-building and is of interest to property scholars, anthropologists, and academics and practitioners in the emerging field of peace and conflict studies.

Following the historic 1999 popular referendum, East Timor emerged as the first independent sovereign nation of the 21st Century. The years since these momentous events have seen an efflorescence of social research across the country drawn by shared interests in the aftermath of the resistance struggle, the processes of social recovery and the historic opportunity to pursue field-based ethnography following the hiatus of research during 24 years of Indonesian rule (1975-99). This volume brings together a collection of papers from a diverse field of international scholars exploring the multiple ways that East Timorese communities are making and remaking their connections to land and places of ancestral significance. The work is explicitly comparative and highlights the different ways Timorese language communities negotiate access and transactions in land, disputes and inheritance especially in areas subject to historical displacement and resettlement. Consideration is extended to the role of ritual performance and social alliance for inscribing connection and entitlement. Emerging through analysis is an appreciation of how relations to land, articulated in origin discourses, are implicated in the construction of national culture and differential contributions to the struggle for independence. The volume is informed by a range of Austronesian cultural themes and highlights the continuing vitality of customary governance and landed attachment in Timor-Leste.

Housing, land and property (HLP) rights, as rights, are widely recognized throughout international human rights and humanitarian law and provide a clear and consistent legal normative framework for developing better approaches to the HLP challenges faced by the UN and others seeking to build long-term peace.
