Land Issues For Urban Governance In Sub Saharan Africa

Sub-Saharan Africa faces many development challenges, such as its size and diversity, rapid urban population growth, history of colonial exploitation, fragile states and conflicts over land and natural resources. This collection, contributed from different academic disciplines and professions, seeks to support the UN Habitat New Urban Agenda passed at Habitat III in Quito, Ecuador, in 2016. It will attract readers from urban specialisms in law, geography and other social sciences, and from professionals and policy-makers concerned with land use planning, surveying and governance. Among the topics addressed by the book are challenges to governance institutions: how international development is delivered, building land management capacity, funding for urban infrastructure, land-based finance, ineffective planning regulation, and the role of alternatives to courts in resolving boundary and other land disputes. Issues of rights and land titling are explored from perspectives of human rights law (the right to development, and women's rights of access to land), and land tenure regularization. Particular challenges of housing, planning and informality are addressed through contributions on international real estate investment, community participation in urban settlement upgrading, housing delivery as a partly failing project to remedy apartheid's legacy, and complex interactions between political power, money and land. Infrastructure challenges are approached in studies of food security and food systems, urban resilience against natural and man-made disasters, and informal public transport.

This paper addresses the problems of governance in municipalities in Africa. The concern has been to adapt traditional systems of governance to the needs of modern urban management. This paper investigates the need for a new analysis of the twin problems of urban land and urban management in sub-Saharan Africa. This need is based on the apparent paradox between the dynamic, city-creating activities of civil societies in all of these countries, and the weak capabilities of states to guide and direct these activities. This paper focuses on governance at the community level, where empowerment and accountability begin. It argues that a prerequisite for dealing with these problems is an institutional environment with which the target populace is familiar and to which it is likely to relate in participating in managing the city. The importance of the particularly dynamic systems of traditional governance at the lowest level in managing urban growth is only recently being recognized.

This is the first book on land administration and reform in Sub-Saharan Africa, and is highly relevant to all developing countries around the world. It provides simple practical steps to turn the hugely controversial subject of "land grabs� into a development opportunity by improving land governance to reduce the risks of dispossessing poor landholders while ensuring mutually beneficial investors’ deals. The book shows how Sub Saharan Africa can leverage its abundant and highly valuable natural resources to eradicate poverty by improving land governance through a ten point program to scale up policy reforms and investments at a cost of USD 4.5 billion. The book points out formidable challenges to implementation including high vulnerability to land grabbing and expropriation with poor compensation as about 90 percent of rural lands in Sub Saharan Africa are undocumented, but also timely opportunities since high commodity prices and investor interest in large scale agriculture have increased land values and returns to investing in land administration. It argues that success in implementation will require participation of many players including Pan-African organizations, Sub Saharan Africa governments, the private sector, civil society and development partners; but that ultimate success will depend on the political will of Sub Saharan Africa governments to move forward with comprehensive policy reforms and on concerted support by the international development community. Its rigorous analysis of land governance issues, yet down-to-earth solutions, are a reflection of Byamugisha's more than 20 years of global experience in land reform and administration especially in Asia and Africa. This volume will be of great interest to and relevant for a wide audience interested in African development, global studies in land, and natural resource management.

Breaking with tradition, this volume identifies the causes of underdevelopment in sub–Saharan Africa by linking historical experience of colonial development policies with their current development problems. This book analyzes the impact of urban and regional planning schemes with (European) colonial roots, for contemporary socio-economic development efforts in sub-Saharan Africa.

Sub-Saharan Africa is urbanizing rapidly, but most countries lack appropriate tools to manage their urban growth. This creates both risks and opportunities for prospective land holders, resulting in a tangle of insecure land rights and claims under multiple tenure systems. Recently, innovative land tools have been proposed and implemented to formalize land tenure. It is envisaged that tenure security for land holders will increase and in turn contribute to poverty reduction. This study evaluates such tools in three peri-urban areas in Lusaka (Zambia), Oshakati (Namibia) and Gaborone (Botswana), with a focus on the perspective of the land holders. The author concludes that the tools are to some extent pro-poor, and makes recommendations for further improvements. These innovative land tools are also considered a necessary addition to conventional and administration tools. This study makes valuable reading for academics, policy makers and practitioners within the land administration domain and related disciplines.

Urban development in sub-Saharan Africa has posed more challenges in recent decades, shifting the focus from rural poverty to urbanised poverty. Because of a rapidly urbanising sub-Saharan Africa coupled with failures in urban management, urban economies have grown slower than correspondent population increase, slum growth has increased and poverty has urbanised. Of all urban challenges, housing has posed serious challenges in sub-Saharan Africa, yet the prime basis of urban housing is land. Land management is key to urban development due to its influences on the social, economic development and urban environmental management. Land and housing are important sectors as urbanisation and urban development accelerate. This book examines the relationship between operations of informal land markets and housing development for planning policies that are responsive to the land market conditions.

The State of the African Cities 2010 goes above and beyond the first report, which provided a general overview of housing and urban management issues in Africa. With the subtitle: Governance, inequity and urban land markets, the report uncovers critical urban issues and challenges in African cities, using social and urban geography as the overall entry points. While examining poverty, slum incidence and governance, the report sheds more light on inequity in African cities, and in this respect follows the main theme of the global State of the World's Cities 2010 report. Through a regional analysis, the report delves deeper into the main urban challenges facing African cities, while provoking dialogue and discussion on the role of African cities in improving national, regional and local economies through sustainable and equitable development. The report has been drafted in cooperation with Urban Land Mark. Through an analytical survey of several African cities, the report examines urban growth, social conditions in slums, environmental and energy issues and, especially, the role of urban land markets in accessing land and housing.
