In this invigorating collection of essays by leading medieval historians, the issue of laity—primarily the ideas and attitudes of lay people—are examined, as expressed in legal cases, charters, chronicles, and collective activities. The contributors focus on narratives from the Middle Ages, during a period of progress from irrational to rational thought. The essays range chronologically and geographically from the 7th to the 16th century, and from West Britain to Papal and urban Italy.

This book contains essays written over the past 25 years about medieval urban communities and about the loyalties and beliefs of medieval lay people in general. Most writing about medieval religious, political, legal, and social ideas starts from treatises written by academics and assumes that ideas trickled down from the clergy to the laity. Susan Reynolds, whether writing about the struggles for liberty of small English towns, the national solidarities of the Anglo-Saxons, or the capacity of medieval peasants to formulate their own attitudes to religion, rejects this assumption. She suggests that the medieval laity had ideas of their own that deserve to be taken seriously.

However, historians have long recognized that medieval culture was characterized by an enormous respect for law and legal procedure. This book makes the case that one cannot understand the era's cultural trends without considering the profound development of law.

This book expands on established doctrine in legal history and sets out a challenge for legal philosophers. The English medieval village community offers a historical and philosophical lens on the concept of custom which challenges accepted notions of what law is. The book traces the study of the medieval village community from early historical works in the nineteenth century through to current research. It demonstrates that some law-making can and has been ‘bottom-up’ in English law, with community-led decisionmaking having a particularly important role in the early common law. The detailed consideration of law in the English village community reveals alternative ways of making and conceiving of law which are not dependent on state authority, particularly in relation to customary and communal property rights. Acknowledging this poses challenges for legal theory: the legal positivism that dominates Western legal philosophy tends to reject custom as a source of law. However, this book argues that medieval customary law ought to be considered ‘law’ if we are ever going to fully understand law – both then and now. The book will be a valuable resource for researchers and academics working in the areas of Legal History, Legal Theory, and Jurisprudence.

This book explores the rise of a Scottish common law from the twelfth century on despite the absence until around 1500 of a secular legal profession. Key stimuli were the activity of church courts and canon lawyers in Scotland, coupled with the example provided by neighbouring England’s common law. The laity’s legal consciousness arose from exposure to law by way of constant participation in legal processes in court and daily transactions. This experience enabled some to become judges, pleaders in court and transactional lawyers and lay the foundations for an emergent professional group by the end of the medieval period.

Some legal rules are not laid down by a legislator but grow instead from informal social practices. In contract law, for example, the customs of merchants are used by courts to interpret the provisions of business contracts; in tort law, customs of best practice are used by courts to define professional responsibility. Nowhere are customary rules of law more prominent than in international law. The customs defining the obligations of each State to other States and, to some extent, to its own citizens, are often treated as legally binding. However, unlike natural law and positive law, customary law has received very little scholarly analysis. To remedy this neglect, a distinguished group of philosophers, historians and lawyers has been assembled to assess the nature and significance of customary law. The book offers fresh insights on this neglected and misunderstood form of law.

What impact did the printing press – a new means of communicating the written word – have on early modern English lawyers? This book examines the way in which law printing developed in the period from 1475 up until 1642 and the start of the English Civil War. It offers a new perspective on the purposes and structures of the regulation of the printing press and considers how and why lawyers used the new technology. It examines the way in which lawyers adapted to the use of printed works and the way in which the new technology increased the availability of texts and books for lawyers and the administrative community. It also considers the wider humanist context within which law printing developed. The story is set against the backdrop of revolutionary changes in English society and the move not only to print the law, but also increase its accessibility by making information available in English. The book will be of interest to lawyers and legal historians, print and book historians and the general reader.

This is the first ever index of contributions to common law Festschriften and fills a serious bibliographic gap in the literature of the common law. The German word Festschrift is now the universally accepted term in the academy for a published collection of legal essays written by several authors to honour a distinguished jurist or to mark a significant legal event. The number of Festschriften honouring common lawyers has increased enormously in the last thirty years. Until now, the numerous scholarly contributions to these volumes have not been adequately indexed. This Index fills that bibliographic gap. The entries included in this work refer to some 296 common law Festschriften indexed by author, subject keyword, editor, title, honorand and date. It therefore includes over 5,000 chapter entries. In addition, there are more than a thousand entries of English language contributions to predominantly foreign language, non-common law legal Festschriften from Germany, Austria, Switzerland, Denmark, Finland, Iceland, Norway and Sweden.
