Excerpt from Mining, Mineral and Geological Law The aim and scope of this book and the importance of a knowledge of mining law to the mining engineer and mine owner in the United States are explained in the introductory chapter, but a few words may be added here concerning existing books that might be used for such purposes. The excellent works of Lindley and Snyder, each in two large volumes, on account of their elaborateness and style of treatment, are not well adapted for the use of others than practicing lawyers, although indispensable to them. The small manuals of mining law and forms are usually too brief to give any adequate space for such statement and explanation of the principles of our complicated system of mining law as will enable it to be understood in any appreciable degree by those for whom they are intended. Moreover, owing to the extensive changes in and additions to the State statutes by the various legislatures in 1907, and the revision of the very important Land Office Rules and Regulations made in the same year, they are no longer safe guides in these respects. Consequently it would seem that a book containing in one volume a brief history of the development and a condensed but systematic exposition of the principles and rules of law that govern mining rights in the United States, together with a compilation of the National and State statutes and the Land Office Rules and Regulations relating thereto, revised to date, ought to be useful to the mining profession, and that the present is a particularly opportune time for its appearance. In the complex and intricate questions that have arisen out of the application of the extralateral provision of the law, a bare statement of the rule, worked out by the courts to govern rights in the various situations that arise in mining operations, would be inadequate to give a comprehension of the law. Aspden v. Seddon (which came before the Court of Appeal in 1875) is one of the few cases (if not the only case) in which the defence of necessary implication has succeeded; and it is perhaps doubtful, whether, in the face of the rule of construction next mentioned, that case is still an authority. The public spirit of litigants may be trusted in the future (as in the past) to endeavour to find examples of what is necessary implication, and to succeed in finding examples of what is not. Excerpt from Mining Law for the Prospector, Miner, and Engineer In adding another work on mining law to those already before the public, it is necessary to give a reason. The present standard works on the subject are the production of mining attorneys, and while the value of their works is unquestioned, they are, perforce, more valuable and suitable for practising attorneys and in connection with mining litigations than for miners and as a guide in the field. This work has been prepared for the miner by a miner - using the word miner as a generic term to include all who may be interested in the subject of mineral rights and titles in contradistinction to mining attorneys - though it is believed that the work will not be without elementary interest and value to the law profession. The purpose in view is to give a simple and easily grasped, though comprehensive idea of the mining law, showing its fabric and structure, that the reader and student may obtain the basic principles and facts upon which to take up either the more advanced study of mining law or use it intelligently and satisfactorily as a prospector, surveyor, claim owner, or property manager. It represents the experience and observation of the writer in the mining profession and as a mineral examiner of the Field Service of the General Land Office, in which capacity he has been in daily contact, in both office and field, with miners, mineral claimants, and the subject of mining rights and titles. To accomplish this two kinds Of information on the subject appeared to be necessary. First, a knowledge Of the mining laws of other countries, for the purpose of being able to compare them with our own and to note the points of difference; and second, the statistics Of production in the principal metal-mining regions of the world, so as to be in a position to judge of the comparative worth Of each law by the results Obtained under it. As the investigation advanced it was found desirable as well as interest ing to take note of the salient features of the history Of the industry in each principal field. This naturally led to an inquiry into ancient and repealed mining legislation and customs, the better to understand those now in'force; which, in its turn, Called for a study of the beginnings, rise and growth of the occupation Of mining.
