Power Sharing Pacts And The Women Peace And Security Agenda

This book offers a comparative lens on the contested relationship between two leading conflict resolution norms: ethnopolitical power-sharing pacts and the women, peace and security (WPS) agenda. Championed by national governments and international organizations over the last two decades, power-sharing and feminist scholars and practitioners tend to view them as opposing norms. Critics charge that power-sharing scholars cast gender as an inconsequential political identity that does not motivate people like ethnonationalism. From a feminist perspective, such thinking serves the interests of ethnicized elites while excluding women and other marginalized communities from key sites of political power. This edited volume takes a different tack: while recognizing the gender gaps that still exist in power-sharing theory and practice, contributors also emphasize the constructive engagements that can be built between ethnopolitical power-sharing and gender inclusion. Three main themes are highlighted: The ‘gender silences’ of existing power-sharing arrangements The impact of gender activism and advocacy on the negotiation and implementation of power-sharing pacts in divided societies The opportunities for linkages between power-sharing and the women, peace and security agenda. The chapters in this book were originally published as a special issue of the journal Nationalism and Ethnic Politics.

The "narrative turn" has recently influenced theories, methods, and research design within the field of international relations. Its goal is, in part, to show how stories about international events and issues emerge and develop, and how these stories influence the uptake and limitations of global policy "solutions" around the world. Through the lens of narrative, this book examines the Women, Peace and Security (WPS) agenda, adopted by the United Nations Security Council twenty years ago. The agenda seeks to increase the participation of women in conflict prevention efforts and to protect the rights of women during conflict and peacebuilding. Those involved in the creation of the WPS agenda, including its strategies, guidelines, and protocols, tend to assume that implementation is the most critical element of it. But what can the stories about the agenda's emergence tell us about its limits and possibilities? Laura J. Shepherd examines WPS as a policy agenda that has been realized in and through the stories that have been told about it, focusing on the world of WPS work at the United Nations Headquarters in New York. She argues that to understand the implementation of the agenda we need to also understand the narration of the agenda's beginnings, its ongoing unfolding, and its plural futures. These stories outline the agenda's priorities and delimit its possibilities--as well as communicate and constitute its triumphs and disasters. As the book shows, much energy and resources are expended in efforts to reduce or resolve the agenda to a singular, essential "thing"--with singular, essential meaning. There is no "true" WPS agenda that practitioners, activists, and policymakers can apprehend and use as their guide; there is only a messy and contested space for political interventions of different kinds. Shepherd shows that the narratives of the WPS agenda incorporate plural logics but that this plurality cannot--should not--be used as an alibi for limited engagement or strategic inaction. Those seeking to realize the WPS agenda might need to live with the irreconcilable, the irresolvable, and the ambiguous.

This work introduces and further develops the feminist strategy of 'norm transfer': the proposal that feminist informed standards created at the level of international criminal law make their way into domestic contexts. Situating this strategy within the complementarity regime of the International Criminal Court (ICC), it is argued that there is an opportunity for dialogue and debate around the contested aspects of international norms as opposed to uncritical acceptance. The book uses the crime of rape as a case study and offers a new perspective on one of the most contentious debates within international and domestic criminal legal feminism: the relationship between consent and coercion in the definition of rape. In analysing the ICC definition of rape, it is argued that the omission of consent as an explicit element is flawed. Arguing that the definition is in need of revision to explicitly include a context-sensitive notion of consent, the book goes further, setting out draft legislative amendments to the ICC 'Elements of Crimes' definition of rape and its Rules of Procedure and Evidence. Turning its attention to the domestic landscape, the book drafts amendments to the United Kingdom (UK) Sexual Offences Act 2003 and to the Youth Justice and Criminal Evidence Act 1999: thereby showing how the revised version of the ICC definition can be applied in context of the UK.

This edited collection aims to enhance our understanding of the utility of power-sharing in deeply divided places by subjecting power-sharing theory and practice to empirical and normative analysis and critique. Its overarching questions are: Do power-sharing arrangements enhance stability, peace and cooperation in divided societies? Do they do so in ways that promote effective governance? Do they do so in ways that promote justice, fairness and democracy? Utilising a broad range of global empirical case studies, it provides a space for dialogue between leading and emerging scholars on the normative questions surrounding power-sharing. Distinctively, it asks proponents of power-sharing to think critically about its weaknesses.
