Promoting Sustainable Innovations In Plant Varieties

This book develops the term ‘Sustainable Innovations’ and defines it on the basis of plant variety innovations that, by their very nature, (i) permit the in situ conservation of agrobiodiversity and genetic variability in diverse geographic and climatic conditions, (ii) do not exclude any potential innovators from the process of innovation, and thereby (iii) ensure that both formal and informal innovations can continue to take place in the generations to come (in both the developed and developing world). The book studies the Indian Plant Variety Protection Act, the UPOV Acts and associated agricultural policies from a legal, philosophical, historical and economic perspective with the aim of determining the means of promoting sustainable innovations in plant varieties and identifying laws, policies and practices that are currently acting as impediments to promoting the same.

Intellectual property (IP) rights impact innovation in diverse ways. This book critically analyses whether additional rights beyond patents, trademarks and copyrights are needed to promote innovation. Featuring contributions from thought-leaders in the field of IP, this book examines the check and balances that already exist in the IP system to safeguard innovation and questions to what extent existing IP regimes are capable of catering to new paradigms of innovation and creativity.

This open access book provides the first systematic overview of existing challenges and opportunities for responsible data linkage, and a cutting-edge assessment of which steps need to be taken to ensure that plant data are ethically shared and used for the benefit of ensuring global food security – one of the UN’s Sustainable Development Goals. The volume focuses on the contemporary contours of such challenges through sustained engagement with current and historical initiatives and discussion of best practices and prospective future directions for ensuring responsible plant data linkage. The volume is divided into four sections that include case studies of plant data use and linkage in the context of particular research projects, breeding programs, and historical research. It address technical challenges of data linkage in developing key tools, standards and infrastructures, and examines governance challenges of data linkage in relation to socioeconomic and environmental research and data collection. Finally, the last section addresses issues raised by new data production and linkage methods for the inclusion of agriculture’s diverse stakeholders. This book brings together leading experts in data curation, data governance and data studies from a variety of fields, including data science, plant science, agricultural research, science policy, data ethics and the philosophy, history and social studies of plant science.

The book brings out an encyclopaedic picture of the potential areas of transformative Indian agriculture through innovations in science, technology, institutional and policy affairs directed in building a self-reliant India (Atmanirbhar Bharat). The book has addressed the challenges to make India free from hunger, poverty and undernutrition, and suggested interventions with focus on all-inclusiveness and sustainability, peace and prosperity, and resilience to climate and other volatilities. Most of these propositions are analogous to the Sustainable Development Goals – Agenda 2030, which India has committed to achieve. The book especially covers critical needs for development on different fragile ecosystems such as coastal, desert, hill, ravine and other marginal ecosystems. The book will act as very useful guidance for the policy makers, and development communities, and a reference document to academicians as well. This book examines the role of local knowledge in promoting agricultural innovation and legislative support for agricultural innovation through intellectual property laws and the protection of farmers’ rights. In assessing the role of intellectual property in promoting agricultural innovation the book examines plant variety rights protection, the patenting of plant varieties and plant breeding methods; gene patents and climate change; open source biotechnology and agricultural innovation and geographical indications and the marketing of agricultural products. As a test bed for the application of the themes of the book, it applies a case study approach to look at the role of local knowledge and intellectual property rights in the cultivation of traditional rice varieties in Kerala, South West India and the extent to which this cultivation is supported by Indian legislation. The book concludes with an examination of the success of self-help groups, such as Farmers’ Clubs. This book appeals to all readers interested in policies to promote sustainable agriculture at a time of increasing food insecurity. A special feature of the book is the case study approach. To date, the role of local knowledge and agricultural innovation has been almost entirely ignored and the role of intellectual property in this space has been largely ignored. The book is a result of a research collaboration between the University of Western Australia and Kerala Agricultural University, funded in part by the Australian Research Council.

This book comprises chapters by leading international authors analysing the interface between intellectual property and foreign direct investment, development, and free trade. The authors search for a balance between the conflicting interests that inherently coexist in intellectual property law. The chapters dig deep into the subjects and notions that have become central in international intellectual property legal developments: i) flexibility, public interest and policy-space for implementation; ii) interfaces between the intellectual property regime and other legal regimes; and iii) the development of international intellectual property law and its influence on national legal orders, which includes the implementation of intellectual property undertakings.
