Reframing Intellectual Property Law In Sri Lanka

This book is a reflection on domestic intellectual property lawmaking from a developing country’s perspective. It focuses on Sri Lanka—a South Asian jurisdiction with a socio-economic, cultural, and political landscape similar to other developing nations in the region, but the intellectual property regime of which has been less explored. The aim of this book is to address the discrepancies, gaps, and flaws in the national intellectual property legal framework of Sri Lanka. In doing so, the book considers Sri Lanka’s obligations under TRIPS and other related intellectual property treaties to which the country is a party. The book also examines approaches adopted by developing countries in the region and beyond, as well as other more developed nations, in calibrating Sri Lanka’s domestic intellectual property regime to better address the country’s domestic needs and national interests. The approach adopted in this book is of relevance, more generally, to policymakers, legislators, legal academics, scholars, jurists, legal practitioners and judges who are keen on exploring the extent to which domestic intellectual property legislation complies with international intellectual property norms and standards and, more importantly, the extent to which domestic law makes use of the flexibilities under international law in addressing domestic needs and national interests.

This report presents a review of Sri Lanka's national innovation system, including in-depth stakeholder interviews regarding the extent to which intellectual property (IP) has been integrated therein. A comprehensive reassessment of the relevance of Gramsci’s theory and practice at the beginning of the twenty-first century. Whilst commentaries on Antonio Gramsci and arguments surrounding his political and intellectual legacy have proliferated, little attention has been hitherto directed to linking the connections and contentions between Political Theory and International Political Economy. This volume brings together leading authorities engaged in common debates to produce, for the first time, a major collection that clarifies, addresses, and lays bare the manifest connections and contentions within political and international theory surrounding the legacy of Antonio Gramsci. Part II focuses on very new developments in Gramsci scholarship concerning the questioning of contemporary world order. Intellectual Property law is a dynamic field; its ever-changing landscape challenges us to constantly revisit the existing laws and policies. Although ideological currents of a second-tier patent (STP) regime are sweeping through the South Asian region in recent years, the concept of utility model or petty patent remains a largely unexplored option in Sri Lanka and in other parts of the South Asian region. Against this backdrop, this book offers an alternative approach to incentivise minor and incremental innovations of SMEs. It also explores whether Sri Lanka and other developing economies in the South Asian region can benefit from such an STP regime if it is tailored to the specific characteristics of the innovation landscape of the country.
