This book, written by an expert in the field, covers some of the following issues, namely high-profile WADA cases such as that of Maria Sharapova, the Bosman ruling, decisions by the Court of Arbitration for Sport (CAS), and footballers’ employment contracts and transfers for enormous amounts. I am honoured to have been invited to write the foreword to this book. Since the publi- tion of Professional Sport in the EU: Regulation and Re-regulation (edited by Andrew Caiger and Simon Gardiner, T.M.C. Asser Press 2000), there have been a number of dev- opments in the European Union in sports law, both in the European Commission and the European Court of Justice. The most significant of these was probably the adoption by the Commission of the White Paper on Sport on 11 July 2007. The White Paper takes stock of the acquis communautaire – the rather prodigious body of European Law including judgements and preliminary rulings of the ECJ – in the sports field and sets out the position of the Commission on three significant aspects of European sport: its societal role, its economic dimension, and its governance. The White Paper also contains concrete proposals for further EU action as part of an Action Plan named after Pierre de Coubertin, the founder of the modern Olympic Games.

This book comes at a critical time for the future development of sports law. It examines key issues of both contemporary and future importance to the administration of sporting activity in the European Union. The book is par ticularly pertinent coming at a time when European Community law is playing a key role in the restructuring of football's transfer system. This forms only one small, though highly significant, part of the fundamental shift that has taken place in European professional sport; away from the self-regulatory autonomy of sporting bodies towards a system more rigidly codified and governed by main stream legal norms and rules. The law, in particular the economic freedoms provided for under the Treaty of Rome, has become a key weapon in the armoury of those who wish to exploit sport to its full commercial potential, free of self-regulatory constraints. It is not only those desirous of exploiting the economic potential of sport, who have made use of European Community law. This book evaluates the status quo of integrity management within sports that involve horses worldwide. Sports governing bodies and international sports federations are very powerful organisations within their sphere and the governance of these sports has created a hegemony which does not necessarily serve the interests of those engaged in sport, rather those who ‘rule’ sport.
