The concept of the common heritage of mankind is one of the most extraordinary developments in recent intellectual history and one of the most revolutionary and radical legal concepts to have emerged in recent decades. The year 1997 marks the thirtieth anniversary of the advent of the concept in the domain of public international law. Ever since its emergence, it has become evident that no other concept, notion, principle or doctrine has brought as much intensive debate, controversy, confrontation and speculation as the common heritage phenomenon did. This is because it is a philosophical idea that questions the regimes of globally important resources regardless of their situation, and requires major changes in the world to apply its provisions. In other words, the application and enforcement of the common heritage of mankind require a critical reexamination of many well-established principles and doctrines of classical international law, such as acquisition of territory, consent-based sources of international law, sovereignty, equality, resource allocation and international personality. This book aims to explore the legal theory and implications of the concept of the common heritage of mankind. It addresses almost all aspects of the concept in the light of the experience of three decades. The author takes into account the elements of the common heritage concept in the fields of jurisprudence, outer space law, the law of the sea, the law of Antarctica, international environmental law, human rights and general principles of public international law. It tries to develop a normative framework through which the concept may offer alternatives for the governance of the global commons.

Some scholars emphasize the importance of a hegemon in creating a regime and giving it momentum. This is called the hegemonic stability theory. The United States, for example, has been instrumental in creating the Bretton Woods system, with organizations such as the World Bank and the International Monetary Fund. The rationale is that a hegemon, being the dominant actor in international politics and economics, often stands to gain the most from the creation of global standards. For instance, while other countries might benefit from it, U.S. companies like Microsoft, Universal Studios, and Pfizer would be among the greatest beneficiaries of a strict global intellectual property regime. As the hegemons use their power to create regimes, their withdrawal similarly can also threaten the effectiveness of regimes. Regimes serve crucial functional needs in international relations. Powerful regimes are considered by some scholars as independent actors in international politics. Although ultimately states create and sustain regimes, once institutionalized, regimes can exert influence in world politics that is practically independent of state sovereignty. The International Atomic Energy Agency, for instance, has certain rights, given to it by states themselves, to monitor nuclear energy activity in countries. Insofar as they are organized by means of treaties among countries, regimes provide an important source of formal international law. Regimes themselves can also be subjects of international law. This book tries to unravel that ideology and to create an alternative vision of a just and democratic world over. In response to a growing sense of dissatisfaction with the state of the world and the state of international relations research, Professor Kim has taken an alternative approach to the study of contemporary world politics. Specifically, he has adopted and expanded the cross-cultural, interdisciplinary, and transnational approach developed by the World Order Models Project (WOMP), an enterprise committed to the realization of peace, economic equality and well-being, social justice, and ecological balance. Systemic in scope and interdisciplinary in methodology, The Quest for a Just World Order explains and projects the issues, patterns, and trends of world politics, giving special attention to the attitudinal, normative, behavioral, and institutional problems involved in the politics of system transformation. Professor Kim also attempts to remedy a number of problematic features of traditional approaches, including a value-neutral orientation; fragmentation and overspecialization; overemphasis on national actors, the superpowers, and stability; and the Hobbesian image of world politics. Part 1 presents a conceptual framework for developing a normative theory of world order. Each of the four chapters in Part 2 examines a specific global crisis in depth, working within the framework laid out in Part 1. In Part 3 a variety of desirable and feasible transition strategies are proposed, and Professor Kim assesses the prospects for achieving a just and humane world order system by the end of this century.

This work intends to contribute to a better understanding of the international law aspects of the ongoing debate on current and future international governance and regulation of areas beyond national jurisdiction, focusing on principles and objectives, institutional arrangements, entitlements and compliance.
