Ruling Bodies

This book is about an epochal shift in ideas that changed the nature and meaning of coercion in modern political thought. It begins with a review of Foucault, Arendt, and Habermas, and points out a discrepancy in the way each thinker understood coercion in modern politics. From here, Varma examines Plato’s Republic, Laws, and Gorgias to provide a framework and context for thinking about this. As the author shows, each work demonstrates a particular style of Platonic statecraft that corresponds to the amount of power the philosopher holds in a city. The Republic demonstrates the philosopher’s rule as a monarch; the Laws demonstrates his rule when he must share power with a few spirited statesmen; and the Gorgias demonstrates his rule in a democracy where power belongs to the people. Ultimately, Varma argues that the philosopher used coercion as a supplementary tool to help harmonize man’s soul with the heavens. When Hobbes recast the cosmos as matter in motion, however, power became the highest ordering principle for political life.

Offering an anthropological perspective, this volume explores the changing relations between law and governance, examining how changes in the structure of governance affect the relative social significance of law within situations of legal pluralism. The authors argue that there has been a re-regulation rather than a de-regulation, propagated by a plurality of regulative authorities and this re-regulation is accompanied by an increasing ideological dominance of rights talk and juridification of conflict. Drawing on insights into such processes, this volume explores the extent to which law is used both as a constitutive legitimation of governance and as the medium through which governance processes take place. Highlighting some of the paradoxes and the unintended consequences of these regulating processes and the ensuing dynamics, Rules of Law and Laws of Ruling will be a valuable resource for researchers and students working in the areas of legal anthropology and governance.

November 2010 sees the first elections in Myanmar/Burma since 1990, to be held as the culmination of the military regime's 'Road Map for Democracy' The conditions under which the elections are being held are far from favourable, although the laws and procedures under which they will be conducted have been in place for seven months and quite widely publicized. Political controls remain repressive, freedom of expression and assembly does not exist, and international access is restricted by government controls as well as sanctions. While the elections represent a turning point for Myanmar/Burma, the lead-up period has not been marked by many notable improvements in the way the country is governed or in the reforming impact of international assistance programmes. Presenters at the Australian National University 2009 Myanmar/Burma Update conference examined these questions and more. Leading experts from the United States, Japan, France, and Australia as well as from Myanmar/Burma have conributed to this collection of papers from the Conference.
