Does Canada need any more collections about legal regulation of sex and sexuality? Volumes exist dealing with sex work and pornographies. Certainly, volumes abound dealing with emerging sexualities in Canada and new sexual freedoms. This book seeks to do more than tell a story of broad generalities about the law. It forges the links between the history of law and modern iterations of judgments pertaining to that law. Hence the uncomfortable line between Victorian morality (often) and modern regulation, is thematically explored through the book. More modern iterations of sexual regulation in Canada are being deployed and, in this book, the authors explore the interplay between emerging digital technologies and legal regulation. Newer laws in Canada have been drafted to recognize that sexual expression can be a means of violence inherently, and thus an exploration of modern sexual digital expression and its emerging jurisprudence represent a new frontier in the regulation of sex and sexuality in Canada. We explore how legal regulation has responded to these new crimes.This collection is founded upon the editors? joint experiences in teaching in law and society programs in Canada. The authors have witnessed cobbled together curriculums which rely upon a potpourri of sources from law, criminology, criminal justice and law and society disciplines. There exists a growing interest from university students and legal scholars alike for a reader in the context of law reform and legal change in respect of sexual politics and movements in Canada, especially in the context of more modern iterations of crime and sexual politics. Furthermore, while this collection is intended to be educational in the main, it will foster broader discussions in the context of legal regulation of sex and sexuality in Canadian jurisprudence.?

The editors, Rosemary Gartner and Bill McCarthy, have assembled a diverse cast of criminologists, historians, legal scholars, psychologists, and sociologists from a number of countries to discuss key concepts and debates central to the field. Throughout history, the law has regulated sexual behaviours. Some regulations eventually become outdated and are no longer enforced. For instance, many states have adultery laws that are rarely or never enforced. Other regulations have been adopted more recently, as culture and technology have advanced. For example, laws regulating internet pornography are relatively recent. Often, these regulations are controversial and prompt analysis and research. It is the purpose of this book to present a variety of original research and legal analyses concerning such regulations. Research in psychology and social justice is particularly applicable to the study of legal regulations of sexual behaviour. As such, this edited volume will take a 'psycho-legal' approach by addressing such issues using both psychological and legal principles. This book will contain original research articles, psycho-legal analyses, and psycho-legal briefs. All will involve current issues relating to the legal regulation of sexual behaviour and its outcomes. Inspired by the political interventions of feminist women of color and Foucauldian social theory, Anna Marie Smith explores the scope and structure of the child support enforcement, family cap, marriage promotion, and abstinence education measures that are embedded within contemporary United States welfare policy. Presenting original legal research and drawing from historical sources, social theory, and normative frameworks, the author argues that these measures violate the rights of poor mothers. Drawing on several historical precedents the author shows that welfare policy has consistently constructed the sexual conduct of the racialized poor mother as one of its primary disciplinary targets. The book concludes with a vigorous and detailed critique of Sen. Hillary Rodham Clinton's support for welfare reform law and an outline of a progressive feminist approach to poverty policy.
