Stopping The Spread Of Nuclear Weapons Countering Nuclear Terrorism

This volume aims to improve understanding of nuclear security and the prevention of nuclear terrorism. Nuclear terrorism is perceived as one of the most immediate and extreme threats to global security today. While the international community has made important progress in securing fissile material, there are still important steps to be made with nearly 2,000 metric tons of weapons-usable nuclear material spread around the globe. The volume addresses this complex phenomenon through an interdisciplinary approach: legal, criminal, technical, diplomatic, cultural, economic, and political. Despite this cross-disciplinary approach, however, the chapters are all linked by the overarching aim of enhancing knowledge of nuclear security and the prevention of nuclear terrorism. The volume aims to do this by investigating the different types of nuclear terrorism, and subsequently discussing the potential means to prevent these malicious acts. In addition, there is a discussion of the nuclear security regime, in general, and an important examination of both its strengths and weaknesses. In summary, the book aims to extend the societal and political debate about the threat of nuclear terrorism. Fischer, who helped draft the original charter of the International Atomic Energy Agency (IAEA), provides a detailed historical account of current non-proliferation treaties and controls. He notes that originally the proliferation problem was how to permit the development of nuclear power (for cheap energy) without permitting countries to develop bombs; now the problem is how to prevent countries determined to build atomic bombs from acquiring the requisite technology. Many technologies (explosives, computers, nuclear energy) that are key to the development of nuclear weapons also have other legitimate applications. Fischer recommends reorienting the current non-proliferation regime, which is largely a Soviet-American invention, into one also supported by economic powers (the European Community and Japan); and that potential new nuclear states and "closet" nuclear powers be brought under broader IAEA controls. The spread of weapons of mass destruction poses one of the greatest threats to international peace and security in modern times--the specter of nuclear, chemical, and biological weapons looms over relations among many countries. The September 11 tragedy and other terrorist attacks have been painful warnings about gaps in nonproliferation policies and regimes, specifically with regard to nonstate actors. In this volume, experts in nonproliferation studies examine challenges faced by the international community and propose directions for national and international policy making and lawmaking. The first group of essays outlines the primary threats posed by WMD proliferation and terrorism. Essays in the second section analyze existing treaties and other normative regimes, including the Nuclear Non-Proliferation Treaty and the Chemical Weapons and Biological Weapons Conventions, and recommend ways to address the challenges to their effectiveness. Essays in part three examine the shift some states have made away from nonproliferation treaties and regimes toward more forceful and proactive policies of counterproliferation, such as the Proliferation Security Initiative, which coordinates efforts to search and seize suspect shipments of WMD-related materials.

Many policymakers and scholars contend that nuclear weapons remain inaccessible to terrorists, and that nuclear means are inconsistent with or disproportionate to their goals. Nevertheless, the historical pattern of nuclear proliferation suggests a trend toward nonstate actor acquisition, a notion supported by recent developments in the black market. Additional evidence suggests that some specific groups have expressed an interest in nuclear weapons. This thesis proposes that there is a terrorist demand for nuclear weapons. Further, its findings suggest that the possibility of terrorist acquisition has grown; and that these nonstate adversaries will enjoy significant advantage over states during nuclear crisis. Terrorists, like states, pursue political objectives and have similar concerns regarding power and security. Lacking state resources, terrorists employ instrumental targeting in pursuit of those objectives, while remaining relatively invulnerable to retaliation. This dynamic will encourage terrorists to acquire and exploit nuclear potential, thereby overturning traditional theories of deterrence. Wishful thinking about nuclear terrorism has discouraged thoughtful analysis of this dilemma. The prospect is sufficiently dire, that a preventive campaign must be launched to stop terrorist acquisition of nuclear capabilities. Policymakers must also prepare for the possible failure of preventive efforts, and search for options that may mitigate nuclear terrorism.

New international approaches to strengthening nuclear security and combating the threat of nuclear terrorism have been introduced throughout the first decade of the 21st century. The adoption of new and revised mandatory international legal instruments, as well as other non-binding initiatives and voluntary mechanisms, have led to improved security measures in this critical area, but there is still a need for substantive and procedural arrangements to be significantly strengthened.This book is a collection of the presentations and deliberations of participants at the NATO Advanced Research Workshop held in Vienna, Austria in January 2010. The workshop was attended by over 100 international experts from more than 20 countries, and the papers presented here summarize current understanding of, and approaches to, the legal framework for nuclear security and counterterrorism.
