EDITOR'S PREFACE The purpose of this book is to provide a fairly broad survey of the Swedish legal system. In order to avoid possible disappointment, it would seem important to make clear from the outset what kind of questions the authors propose to answer and what groups of readers they are addressing. The easiest way to do this is to set out what we are not purporting to do. Thus, the book is not intended to serve as a primer for students who possess no knowledge of "the law", i. e. of the concepts, ideas and solutions of at least one legal system. Nor is it the purpose of the authors to give practitioners the kind of precise, techni cal answers to isolated questions that they need when advising their clients on the proper course of action in business, or litigation, con ducted within the framework of the legal system described.

Derived from the renowned multi-volume International Encyclopaedia of Laws, this book provides ready access to the law applied to cases involving cross border issues in Sweden. It offers every lawyer dealing with questions of conflict of laws much-needed access to these conflict rules, presented clearly and concisely by a local expert. Beginning with a general introduction, the monograph goes on to discuss the choice of law technique, sources of private international law, and the relevant connection with other laws. Then follows clear description and analysis of the rules of choice of law on natural and legal persons, contractual and non-contractual obligations, movable and immovable property, intangible property rights, company law, family law (marriage, cohabitation, registered partnerships, matrimonial property, maintenance, child law), and succession law (including testamentary dispositions). The presentation concludes with an overview of relevant civil procedure, examining lex fori and issues of national and international jurisdiction, acceptability and enforcement of foreign judgements, and international arbitration. Its succinct yet scholarly nature, as well as the practical quality of the information it provides, make this book a valuable resource for lawyers handling cases in Sweden. In Conquest and the Law in Swedish Livonia (ca. 1630-1710), Heikki Pihlajamäki offers an exciting account of the law in seventeenth-century Livonia, conquered by Sweden. The volume demonstrates how the differences in legal cultures affected the Livonian judiciary and legal procedure in the region.

Moving beyond the question of whether an area of scholarly investigation can truly be characterized as 'legal', Exploiting the Limits of Law combats the often unhelpful constraints of law's subject-matter and formal processes. Through a process of reflection on the limits of law and repeated efforts to redraw them, this book challenges the general sense of pessimism among feminists and others about the usefulness of law as an instrument of change. The work combines theoretical analysis of the law's boundaries with investigation of the practical settings for changing legal and policy environments. Both the empirical focus of this volume, and its underlying theoretical concern with the limits of the law and its gender implications, render it of interest to legal scholars throughout the world, whether of EU law, feminism, social policy or philosophy.

The purpose of this book is to present to lawyers outside Sweden an introduction to Private International Law as applied in Sweden. As in the original Swedish version, (Internationell Privatriitt. Metod och Material, Stockholm 1962), emphazis is put on the structure and func tioning of conflict law, and the book does not attempt to present a comprehensive survey of Swedish conflict rules. A resume of these rules has, however, been included in the English edition. The author wants to express his thanks to those who have helped to make possible the publication of this book. Generous support was given by the Swedish State Council for Social Science Research. Dr. Stig Stromholm, Uppsala, prepared the translation into English of the original Swedish text. Some alterations were subsequently made in the, English version, including minor deletions of material which had ap peared in the Swedish original and the addition of some new material, including the whole of present chapter IV. The English text as a whole was finally revised by the author with the help, in the case of chapters I, IV, V and part of chapter II, of Mrs. Helen Moats Eek (Ph. D. , University of Chicago) and, in the case of chapter III and part of chapter II, of Mr. Richard Cox (B. Sc. Econ (Hons. ), F. R. Econ. Soc. ). This book offers foreign readers an overview and understanding of the most important aspects of the law and legal system in Sweden, from the legal institutions to more specific topics such as contract law, tort law and family law. These presentations are not exhaustive but rather meant to give the reader a sufficient enough understanding to be somewhat orientated in the Swedish legal system. The book is written for non-Swedish lawyers faced with specific legal issues involving Swedish law. It is also addressed to foreign law students in need of an overview of the Swedish legal system in order to help them in their further studies at Swedish universities. This third edition takes up many of the legislative changes that have recently been adopted due to the requirements of EU membership and law. Most recent and significant include the amendments to the Tort Act to allow for damages of violations of the European Convention, the significant amendments to the constitutional Freedom of the Press Act, as well as the adoption of the 2017 Local Government Act and Administrative Procedures Act.
