This colorful portrait of law and society during a period of rapid social change reaches a counter-intuitive conclusion about the role of law in injury cases: globalization has led ordinary Thai people to turn away from courts and lawyers and to embrace a form of religious practice that leaves them without any remedy for harms they have suffered.

Khwan is certainly one of the most enigmatic concepts one encounters in the study of the Tai-speaking world. Variously rendered as ‘soul’, ‘vital principle’ or ‘life essence’, the concept eludes unambiguous translations as Western ontologies and the languages that reproduce them simply lack an analogous signifier. While a lot has been written on khwan, it seems that little progress was made in understanding their place in Tai conceptualisations of personhood and sociality. One reason for this may be that authors addressing khwan in their scholarship are frequently referring to the same seminal publications while ignoring others. This fostered a quasi-canonical understanding of what khwan are that is rarely critically scrutinised. With this edited volume we seek not only to honour Barend Jan (Baas) Terwiel, but also to problematise this conventional understanding of what khwan are. In the field of Tai Studies, Baas’ name stands out as a beacon of knowledge and understanding, illuminating the rich tapestry of Thailand’s history, culture, and society. Through meticulous scholarship and a profound love for the subject, Baas has left an indelible mark on the field, enriching our understanding of Thailand in ways that go beyond the surface. Join us on a journey through texts Baas has written over 50 years in order to explore what khwan are and how Tai-speakers all over the Tai-speaking world interact with them in order to strengthen their well-being and maintain personhood. Our goal with this volume is to make Baas scholarship on khwan more easily available and thus to celebrate his remarkable contributions to the world of Tai Studies. Therefore, we have edited, commented, and streamlined his original and sometimes hard to find texts and ordered them in a way that allows readers to better understand khwan as well as their similarities and differences all over the Tai-speaking world.

Divination is an important feature of cultures all over the world. While some may still question the efficacy of divination systems, they continue to serve their communities by diagnosing ailments, prescribing healing treatments, and solving problems. Yet despite their universality, there are relatively few comprehensive studies of divination systems. This volume seeks to fill this gap regarding the use of divination in healing. Here some of the world’s leading authorities draw on their own fieldwork and participation in ritual to present detailed case studies, demonstrating that divination rituals can have therapeutic effects. As the contributors examine the systems of knowledge that divination articulates and survey the varieties of divinatory experience, they seek to analyze divination as an epistemological system, as a social process, and as a therapeutic endeavor. While some of their findings reinforce traditional assumptions about the importance of social control, spirit relations, and community support in the divination process, the authors place these considerations within new epistemological frameworks that emphasize the use of alternative modes of knowing. In this wide-ranging volume, readers will find coverage of classic Ifa systems; Buddhist-influenced shamanic practices in the former Soviet Union; the reconciliation of Muslim beliefs and divinatory practices in Thailand; Native American divination used in diagnosis; Maya calendrical divination in Guatemala; mediumistic and chicken oracle divination among the Sukuma of Tanzania; Ndembu divination, focusing on the process of collective healing; and divination among the Samburu (Maasai) of Kenya, featuring dialogues from actual healing sessions. Together, these contributions argue for new perspectives on the study of divination that emphasize not only the epistemological roots of these systems but also their multifaceted therapeutic functions. Divination and Healing is a rich source of both data and insight for scholars of ritual, religion, medical anthropology, and the psychology of altered states of consciousness.

Ethnographies of law are historically associated with anthropology and the study of far-away places and people. In contrast, this volume underscores the importance of ethnographic research in analyzing law in all societies, particularly complex developed nations. The Book Develops Two Major Themes. The First Theme Attempts To Understand The Sources Of Value Orientation Of The Thai People, And Their Individual And Group Behaviour. To This End The Study Examines Three Major Value Systems And Their Institutions, As Well As Their Mutual Relationship And Interaction. As The First Value System, The Study Examines The Theravada Buddhism As Founded By The Buddha, Then Focuses On Its Application In Thailand, On Buddhist Ethics And Morality, On The Conflicts Between Some Aspects Of Buddhism And The Rapidly Changing Society And, Finally, On Various Movements Attempting To Reform Buddhism In That Country. As The Second Major Value System, The Study Examines The Role Which Animism And The Spirit Worship Play In The Daily Life Of The Thai People, Their Symbolism, And Their Fusion With Buddhism And Its Values And Institutions At The Grassroot Level Of The Society. As The Third Value System, The Study Discusses Various Theories Which Attempt To Explain The Psycho-Cultural Values And Attitudes Of The Thai People, How These Interact With Buddhism And Animism, And How They Add Another Dimension To The Already Complex Pattern Of Social Behaviour. These Three Value Systems Interact And Define The Parameters Within Which All Aspects Of The National Life Political, Cultural, Economic And Others Are Actualized. The Second Major Theme Of The Book Concentrates On The Position Of Women In Thailand. It Begins With The Explanation Of The Attitudes Which The Buddha Himself Held Towards The Women, Examines The Status Of Women In Early Buddhist Societies And Of Those Women Who Chose To Renounce The World And Join The Buddhist Order To Seek Personal Salvation, As Well As The Role Of The Lay Women In A Buddhist Society At That Time. The Book Then Focuses On The Position Of Women In The Thai Society Through Various Stages Of Its History, And Culminates In The Discussion Of The Legal Position Of Women Today And The Attempts To Improve Their Status. However, In Treating The Latter Subject The Study Is Descriptive Rather Than Prescriptive, Leaving It To The Thai Women Themselves To Decide Which Remedies To Pursue To Improve Their Position.
