This manual is an edited collection of recent articles and resource materials prepared by the American Bar Association's Commission on Mental and Physical Disability Law. This manual discusses in detail the first three titles of the ADA, dealing with employment, state and local government services, and public accommodations, and devotes less attention to Titles IV and V, concerning telecommunications and the Act's miscellaneous provisions. A major audience for this manual is the public sector: state and local governments, courts, and other publicly supported programs and activities. Substantial portions of the manual will also be useful for employers, businesses, libraries, and the legal profession, including lawyers, law firms, and law schools. Moreover, the manual is written for both lawyers and non-lawyers.

A guide developed by the U.S. Architectural & Transportation Barriers Compliance Board to assist in the use of its Americans with Disabilities Act (ADA) Accessibility Guidelines (ADAAG) for Buildings & Facilities. It explains some of the basic considerations for accessible design & clarifies specific ADAAG provisions in an effort to address frequently asked questions. Chapters: introduction & information sources; instructions, & minimum requirements; scoping & technical requirements; & special occupancies. It is important that this manual be used with a copy of ADAAG since it does not address or reprint all the information contained in ADAAG.

This handbook's aim is to provide information and assistance on the Americans with Disabilities Act of 1990 to people with disabilities, businesses, and the affected public. The handbook contains annotated regulations for titles I, II, and III; resources for obtaining additional assistance; and several appendixes of supplementary information. Title I covers equal employment opportunity for individuals with disabilities, Title II addresses nondiscrimination on the basis of disability in state and local government services, and Title III focuses on nondiscrimination on the basis of disability by public accommodations and in commercial facilities. For each title, a summary and background are provided, followed by a rulemaking history, regulatory process matters, outline of the rule, and an annotated rule or regulations. The resource section lists 16 Federal government organizations and 75 nongovernment organizations, with descriptions of their activities and focus areas. Appendixes provide the text of the law, accessibility guidelines, a chart of coverage and effective dates, definitions of terms, legislative history, disability-related tax provisions applicable to businesses, Supreme Court cases and regulations related to Section 504 of the Rehabilitation Act of 1973, and a list of acronyms. (a) Design and construction. (1) Each facility or part of a facility constructed by, on behalf of, or for the use of a public entity shall be designed and constructed in such manner that the facility or part of the facility is readily accessible to and usable by individuals with disabilities, if the construction was commenced after January 26, 1992. (2) Exception for structural impracticability. (i) Full compliance with the requirements of this section is not required where a public entity can demonstrate that it is structurally impracticable to meet the requirements. Full compliance will be considered structurally impracticable only in those rare circumstances when the unique characteristics of terrain prevent the incorporation of accessibility features. (ii) If full compliance with this section would be structurally impracticable, compliance with this section is required to the extent that it is not structurally impracticable. In that case, any portion of the facility that can be made accessible shall be made accessible to the extent that it is not structurally impracticable. (iii) If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would be structurally impracticable, accessibility shall nonetheless be ensured to persons with other types of disabilities, (e.g., those who use crutches or who have sight, hearing, or mental impairments) in accordance with this section.
