The Eu S Decision Traps

Fritz W. Scharpf's renowned model of the 'joint-decision trap' suggestes that the requirements of (nearly) unanimous decisions in the EU's Council of Ministers, combined with conflicting preferences among member governments, will systematically limit the problem-solving effectiveness of European policies. However, certain conditions have significantly changed in the 25 years since the theory was first posited. In particular, the unanimity rule has been replaced by qualified-majority voting in most issue areas, and successive rounds of enlargement have augmented the diversity of member state interests and preferences. This volume examines the continued relevance of the model. It presents a comparative study on the differential politics in EU policies. Looking at the political dynamics in an array of EU activities, it analyses breakthroughs as well as stalemates and asks why leaps occur in some areas whilst blockages characterise others. The dynamics that allow the EU to escape various forms of decision trap are analysed in-depth, including those suggested by 'rationalist' theorists (supranational-hierarchical steering, treaty-base games, and arena shifting) and those suggested by 'constructivist' approaches (socialisation). The volume concludes that when the EU is confronted with a high degree of problem pressure in a given issue area, these mechanisms will often not be available because most remain outside politicians' immediate grasp.

This open access book provides an exhaustive picture of the role that annulment conflicts play in the EU multilevel system. Based on a rich dataset of annulment actions since the 1960s and a number of in-depth case studies, it explores the political dimension of annulment litigation, which has become an increasingly relevant judicial tool in the struggle over policy content and decision-making competences. The book covers the motivations of actors to turn policy conflicts into annulment actions, the emergence of multilevel actors’ litigant configurations, the impact of actors’ constellations on success in court, as well as the impact of annulment actions on the multilevel policy conflicts they originate from.

Discussing what we may learn from thinking about the EU in federal terms represents a two-fold challenge. It is on the one hand a matter of establishing ‘how federal’ the EU is (the EU’s federal challenge). On the other, the EU has federal features but is not a state, thus raising the question of whether federal theory and practice may have to be adapted to take proper account of the EU (the EU’s challenge to federalism). The contributions to this collection supplement and extend existing scholarship through focusing on two important lines of inquiry. The first focuses on the relationship between federalism and democracy, with particular emphasis on how federal systems respond to and deal with citizens’ interests and concerns, within and outside the political system. Representation is explored both in the process of federalization, and as a feature of established systems. The second line of inquiry places the emphasis on the relationship among the governments of federal systems. The focus is on intergovernmental relations, and the particular merits that emanate from studying these from a federal perspective. After the participative and deliberative turns in both democratic theory and EU studies, we are currently witnessing a ‘representative turn’ to which this volume contributes by addressing the relation between representation and democracy in the EU. Although in the Lisbon Treaty the EU conceives itself as a representative democracy, the meaning of this concept in a supranational polity is far from clear – either in theory or practice. Instead, the historically contingent link between representation and democracy is today severely challenged by various processes of diversification at all levels of political action (national, regional, supranational). These processes challenge our understanding of representative democracy as involving electoral democracy within clearly delineated nation-states, provoking a situation in which ‘new frontiers’ of representation develop. Consequently, it becomes increasingly difficult to provide normative standards as well as accurate assessments of democratic representation in the EU. This volume addresses these core challenges of representative democracy in the EU from normative, theoretical and methodological perspectives.
