The State Of Access

It’s been ten years since open data first broke onto the global stage. Over the past decade, thousands of programmes and projects around the world have worked to open data and use it to address a myriad of social and economic challenges. Meanwhile, issues related to data rights and privacy have moved to the centre of public and political discourse. As the open data movement enters a new phase in its evolution, shifting to target real-world problems and embed open data thinking into other existing or emerging communities of practice, big questions still remain. How will open data initiatives respond to new concerns about privacy, inclusion, and artificial intelligence? And what can we learn from the last decade in order to deliver impact where it is most needed? The State of Open Data brings together over 60 authors from around the world to address these questions and to take stock of the real progress made to date across sectors and around the world, uncovering the issues that will shape the future of open data in the years to come.

This book documents a worrisome gap between principles and practice in democratic governance. The State of Access is a comparative, cross-disciplinary exploration of the ways in which democratic institutions fail or succeed to create the equal opportunities that they have promised to deliver to the people they serve. Despite decades of substantial investments by the federal government, state governments, colleges and universities, and private foundations, students from low-income families as well as racial and ethnic minority groups continue to have substantially lower levels of postsecondary educational attainment than individuals from other groups. Costliness, excessive delay, bias against the weak, corruption, underfunding, insufficiency of legal skills and shortage of training programmes (for the judicial staff in its diversity), complexity of legal rules and procedures, including the language of both the law and the Court, dependency vis-à-vis the political authorities; these are flaws documented as hindering equal and effective access to Burundi’s formal state court justice system. This book argues that engaging with out-of-court justice in Burundi’s legal pluralism model may positively impact on people’s access to justice, particularly for the poor and the underprivileged.

This synthesis reports how various agencies have acted on the various components of an access management program, what have been barriers to action, and how new efforts might improve implementation of access management strategies.
