To Protect

Every year tens of millions of individuals suffer grave abuses of their human rights. These violations occur worldwide, in war-torn countries and in the wealthiest states. Despite many of the abuses being well-documented, little seems to be done to stop them from happening. The United Nations was established to safeguard world peace and security, development, and human rights yet it is undeniable that currently is it failing to protect the rights of a great many people from the victims of ethnic cleansing, to migrants, those displaced by war and women who suffer horrendous abuse. This book looks at the reasons for that failure. Using concrete examples intertwined with explanations of the law and politics of the UN, Rosa Freedman offers clear explanations of how and why the Organisation is unable, at best, or unwilling, at worst, to protect human rights. Written for a non-specialist audience, her book also seeks to explain why certain countries and political blocs manipulate and undermine the UN s human rights machinery. Failing to Protect demonstrates the urgent need for radical reform of the machinery of human rights protection at the international level.

Failure-to-protect policies and practices are intended to better ensure the safety and protection of children. But as this book demonstrates, these policies actually increase danger for children and for their mothers. While failure to protect is not always encoded in policy documents, practices that engage mothers and hold them responsible for violence in the home, while excusing or ignoring the male offender, are common. Moreover, these actions most often play out on the shoulders of marginalized and already oppressed women and, in a cruel twist, place blame on mothers because they are unable to protect their children from factors beyond their control, such as poverty, racism, intimate partner violence and inadequate housing. In this book, writers from Canada, the U.S., the U.K. and Australia explain how the concept of failure to protect emerged and how it differentially impacts child welfare clients by virtue of their gender, race and class positions. Chapters dedicated to child sexual abuse and intimate partner abuse, for example, illustrate just how ineffective failure-to-protect policies are at protecting both women and children. Beyond a critique of child protection systems, the book proposes innovative and effective alternatives to policies and practices informed by failure to protect. In 2011, the United Nations Security Council adopted Resolution 1973, authorizing its member states to take measures to protect Libyan civilians from Muammar Gadhafi’s forces. In invoking the “responsibility to protect,” the resolution draws on the principle that sovereign states are responsible and accountable to the international community for the protection of their populations and that the international community can act to protect populations when national authorities fail to do so. The idea that sovereignty includes the responsibility to protect is often seen as a departure from the classic definition, but it actually has deep historical roots. In Sovereignty and the Responsibility to Protect, Luke Glanville argues that this responsibility extends back to the sixteenth and seventeenth centuries, and that states have since been accountable for this responsibility to God, the people, and the international community. Over time, the right to national self-governance came to take priority over the protection of individual liberties, but the noninterventionist understanding of sovereignty was only firmly established in the twentieth century, and it remained for only a few decades before it was challenged by renewed claims that sovereigns are responsible for protection. Glanville traces the relationship between sovereignty and responsibility from the early modern period to the present day, and offers a new history with profound implications for the present.

The Responsibility to Protect (R2P) principle is the international community's major response to the problem of genocide and mass atrocities. Although far from perfect, this book argues that R2P offers the best chance we have of building an international community that works to prevent these crimes and protect vulnerable populations.

‘Responsibility to Protect and Prevent: Principles, Promises and Practicalities’ explores the evolution of responsibility to protect (R2P), a principle which – according to its supporters – has evolved into a new type of responsive norm for how the international community should react to serious and deliberate human rights violations. Arguing that the R2P ethos has been misunderstood and used ineffectively, this work defends the validity of R2P and urges for a more practical understanding that moves beyond theory. The progression of R2P from an initial concept to formal ratification has been a very difficult one, with a great deal of disagreement over its validity as a substantive norm in international affairs. The key disagreement is not that protection or prevention are unimportant, but rather how the fine-sounding R2P principles are supposed to work in practice. This volume presents a number of important arguments that are directly related to the state vs. human security debate, with a critical analysis of the nexus between the protection verses prevention theses. Through the case study of the Libyan Crisis, Janzekovic and Silander offer an example of the R2P thesis in action, and support the claim that prevention should be more than an adjunct to protection.
