The September 11, 2001 terrorist attacks gave new momentum to European Union (EU) initiatives to improve law enforcement cooperation against terrorism both among its 25 member states and with the United States. Washington has largely welcomed these efforts, recognizing that they may help root out terrorist cells and prevent future attacks. However, the United States and the EU continue to face several challenges as they seek to promote closer cooperation in the police, judicial, and border control fields. This report will be updated as needed.

The September 11, 2001, terrorist attacks on the United States and the subsequent revelation of Al Qaeda cells in Europe gave new momentum to European Union (EU) initiatives to combat terrorism and improve police, judicial, and intelligence cooperation among its member states. Other deadly incidents in Europe, such as the Madrid and London bombings in 2004 and 2005 respectively, injected further urgency into strengthening EU counterterrorism capabilities and reducing barriers among national law enforcement authorities so that information could be meaningfully shared and suspects apprehended expeditiously. Among other steps, the EU has established a common definition of terrorism and a common list of terrorist groups, an EU arrest warrant, enhanced tools to stem terrorist financing, and new measures to strengthen external EU border controls and improve transport security. Over the years, the EU has also encouraged member states to devote resources to countering radicalization and terrorist recruitment, issues that have been receiving renewed attention in light of growing European concerns about the possible threats posed by European fighters returning from the conflicts in Syria and Iraq.

Promoting law enforcement and intelligence cooperation with the United States has been another top EU priority since 2001. Washington has largely welcomed enhanced counterterrorism cooperation with the EU. Since 9/11, contacts between U.S. and EU officials on police, judicial, and border control policy matters have increased substantially. A number of U.S.-EU agreements have been reached; these include information-sharing arrangements between the United States and EU police and judicial bodies, U.S.-EU treaties on extradition and mutual legal assistance, and accords on container security and airline passenger data. In addition, the United States and the EU have been working together to curb terrorist financing, strengthen transport security, and address the foreign fighter phenomenon. Nevertheless, some challenges persist in fostering closer U.S.-EU cooperation in these fields. Among the most prominent and long-standing are data privacy and data protection issues. The negotiation of several U.S.-EU information-sharing agreements, from those related to tracking terrorist financial data to sharing airline passenger information, has been complicated by EU concerns about whether the United States could guarantee a sufficient level of protection for European citizens' personal data. EU worries about U.S. data protection safeguards and practices were further heightened by the unauthorized disclosures of U.S. National Security Agency (NSA) surveillance programs in mid-2013 and subsequent allegations of U.S. collection activities in Europe. Other issues that have led to periodic tensions include detainee policies, differences in the U.S. and EU terrorist designation lists, and balancing measures to improve border controls and border security with the need to facilitate legitimate transatlantic travel and commerce. Congressional decisions related to data privacy, intelligence-gathering, border controls, visa policy, and transport security may affect how future U.S.-EU counterterrorism cooperation evolves.

This book contributes to the understanding of the counter-terrorism (CT) policy of the European Union (EU) by offering a set of analyses focusing on its external dimension. Whilst calling for the combination of internal and external policies as well as cooperation with third countries and international institutions, the external dimension of EUCT challenges previous assumptions on the functioning of the EU and offers new testing ground for the latest theoretical and methodological approaches. This volume provides the first systematic assessment of the external dimension of EUCT. It covers transatlantic counter-terrorism cooperation, the interaction between EU institutions and policies, theoretical debates on EU actorness in counter-terrorism and the role of judicial institutions in international counter-terrorism. Furthermore, it draws attention to the need for engaging in new discussions over the post-Lisbon Treaty Common Foreign and Security Policy (CFSP), the international fight against terrorism, and the way international actors cooperate and compete on the security arena. It will be of interest for both academics and practitioners working on EU foreign policy, transatlantic relations and international counter-terrorism. It will also be of interest for students and journalists specialized on European and international affairs. This book was published as a special issue of European Security.

This book analyses the cooperation between the European Union and the United States on internal security and counter-terrorism since the 9/11 terrorist attacks. In particular, four areas of cooperation are examined: customs and supply chain security; judicial cooperation (the mutual legal assistance and extradition agreements); law enforcement cooperation (the Europol-US agreements); and the EU-US agreements for the sharing of air passengers’ data (PNR agreements). These cases are analysed through a conceptual framework based on the theories of international regimes, with the data being drawn from an extensive documentary analysis of media sources collected through the 'Nexis' database, official documents, and from 13 semi-structured elite interviews with US and EU officials. The book argues that the EU and the US have established a transatlantic internal security regime based on shared principles, norms, rules, and interests. While at the beginning of this process the EU had a more reactive and passive stance at the later stages both the EU and the US were active in shaping the transatlantic political agenda and negotiations. The book demonstrates how the EU has had a much more proactive role in its relations with the US than has often been assumed in the current literature. This book will be of much interest to students of EU policy, foreign policy, international security and IR in general.
