Voluntary Guidelines To Support The Progressive Realization Of The Right To Adequate Food In The Context Of National Food Security Adopted By The 127th Session Of The Fao Council November 2004

These guidelines, adopted by the FAO Council in November 2004, seek to provide practical guidance to national governments on actions to establish frameworks to promote the right to adequate food in the national context of food security, in order to achieve the goals of the World Food Summit Plan of Action. The guidelines represent a step towards integrating human rights into the work of agencies dealing with food and agriculture, and they establish an additional instrument to combat hunger and poverty and to accelerate attainment of the Millennium Development Goals.

With only five years left until the 2015 deadline to achieve the Millennium Development Goals, food security still is a dream rather than reality: 'a situation that exists when all people, at all times, have physical and economic access to sufficient, safe and nutritious food to meet their dietary needs and food preferences for an active and healthy life'. Political commitments at world summits on food security, market-based agricultural policies, science-based food safety regulation and voluntary guidelines on the right to food have not ended hunger, malnourishment or food safety crises in our world. The question arises whether food insecurity is a situation that exists in spite of these commitments and legal measures, or rather due to them? This book has three purposes. Firstly, it offers insights in how law, politics and the right to food contribute to food security in both positive and negative ways. For this purpose, different theories, concepts and methodologies from legal, political, anthropological and sociological sciences are used and developed. Secondly, the book explains that food security and food policies cannot be treated as given, at one level or in one domain only. This is done in different ways: by pointing out the emergence of new paradigms on food security, human rights and science that shape food policies; by showing how law and policies at one level affect food security at another level; and by treating food security and food policies as linked to governance regimes of agriculture, food, feed, water or property. Finally, the book offers scholarly analysis of paradigms and practices but also presents social science-based ways to indirectly contribute to food security, varying from improving justiciability to building trust, from seeking ways to address non-scientific concerns to creating room for plurality of lifestyles and norms, from unmasking dominant discourse to understanding or strengthening abilities or arrangements to cope with vulnerability.

International Food Law and Policy is the first interdisciplinary piece of academic literature of its kind with a comprehensive, reader-friendly approach to teaching the major aspects of food regulation, law, policy, food safety and environmental sustainability in a global context. The sections are grouped by continents and focus on a range of cross-disciplinary subjects, such as public health, international food trade, the right to food, intellectual property and global regulatory aspects of food production. It is now more than a decade since the Right to Food Guidelines were negotiated, agreed and adopted internationally by states. This book provides a review of its objectives and the extent of success of its implementation. The focus is on the first key guideline – "Democracy, good governance, human rights and the rule of law" – with an emphasis on civil society participation in global food governance. The five BRICS countries (Brazil, Russia, India, China and South Africa) are presented as case studies: representing major emerging economies, they blur the line between the Global North and South, and exhibit different levels of human rights realisation. The book first provides an overview of the right to adequate food, accountability and democracy, and an introduction to the history of the development of the right to adequate food and the Right to Food Guidelines. It presents a historical synopsis of each of the BRICS states’ experiences with the right to adequate food and an analysis of their related periodic reporting to the Committee on Economic, Social and Cultural Rights, as well as a specific assessment of their progress in regard to the first guideline. The discussion then focuses on the effectiveness of the Right to Food Guidelines as both a policy-making and monitoring tool, based on the analysis of the guidelines and the BRICS states.

This volume analyses relationships between patent rights and human rights, focusing on the right to food. Whether the TRIPS Agreement and the International Covenant on Economic, Social and Cultural Rights actually conflict, is analyzed through different techniques of assessing treaty conflict.

Consumers are a powerful force for change towards a sustainably developing world that leaves no one behind and respects the human rights of all. This publication is aimed at making the connections between the important work of consumer organizations and the realization of the right to adequate food, increasing the visibility of these organizations and highlighting their importance to food security, healthy diets and food systems transformations. It is also intended to support consumer organizations in their awareness raising, and capacity development efforts towards even greater impact. In showcasing how the work of consumer organizations contributes towards securing the right to adequate food for all at local, national, regional and global level, it seeks to reinforce their place as vital partners at the policy and decisionmaking table. It is designed as a complement to Consumer Organizations in Action: a growing community of consumer organizations, presenting their experiences in food issues, as well as facilitating networking, and the exchange of knowledge, skills and good practices.

This publication analyses the interplay between the rights to social protection and adequate food, as well as the importance of a human rights-based approach to social protection. It describes the importance of having legally enforceable rights, clear institutional responsabilities, transparency of eligibility criteria, application and termination procedures.

While the right to adequate food is often discussed in the context of developing countries, especially in situations where access to adequate food is a problem on a larger scale, this book focusses on the right to food in two Western countries in which theoretically the circumstances allow this right to be enjoyed by each individual. Through a legal comparative study, the enforceability of the right to food is compared between the Netherlands and Belgium in light of the current UN Human Rights system. There seems to be a difference between what the countries do, what they say they do, and what they should do on the matter. As it appears, the coincidental constitutional circumstances mainly determine the enforceability of the right to food, rather than the content of the human right in itself. This book includes a thorough analysis of suitable comparative legal methodology and the embedment of the right to food in the UN human right system. Furthermore, for both countries, an in-depth analysis of the case law on the right to food (mostly concerning the status of foreigners), the constitutional context in which the Judiciary operates, and the relevant UN reports and subsequent procedures are outlined. Finally, recommendations are made to both countries and the relevant UN Committees.
