Wipo Guide On The Licensing Of Copyright And Related Rights

The WIPO Guide provides a practical overview of licensing of copyright and related rights in a global marketplace, for literary, musical, graphic and pictorial works, motion pictures, multimedia entertainment and education products and computer software. Internationally renowned authors address each industry in turn, as well as giving an overview of the general business and legal principles involved in the licensing of copyright and related rights, and their collective management.

This Guide seeks to clarify and explain the legal principles enshrined in the copyright and related rights treaties administered by WIPO, and their relationship with policy, economic, cultural and technological considerations. It will be particularly helpful to governments, creators, businesses, the legal profession, academics, consumers and students in all WIPO Member States.

This booklet is intended to provide an introduction for non-specialists or new-comers to the subject of copyright and related rights. It explains in layman's terms the fundamentals underpinning copyright law and practice. It describes the different types of rights which copyright and related rights law protects, as well as the limitations on those rights. And finally it briefly covers transfer of copyright and provisions for enforcement.

This Guide, prepared by Rina Elster Pantalony, was recently updated to reflect the tremendous developments since it was first published in 2007, in particular Digital Rights Management, the role of social media as a business opportunity and traditional knowledge. The two-part Guide first describes IP issues relevant to museums then reviews existing business models that could provide museums with appropriate opportunities to create sustainable funding, and deliver on their stated objectives.

The aim of this Guide is to present, as simply and clearly as possible, the contents of the Berne Convention and to provide a number of explanations as to its nature, aims and scope.
