Excerpt from A Treatise on the Law of Damages The general plan Of this work is as follows: The first chapter contains a general survey Of the subject; the nine chapters following, a statement and illustration Of elements, principles and rules relating to it; the next ten chapters the law Of damages applicable in cases Of breaches of con tracts; the following fourteen chapters the law of damages in all the various classes of torts; the succeeding one relates to damages under various statutes; the next chapter discusses the subject of nominal damages; and the last treats Of the power and discretion of the court to set aside verdicts for excessiveness or inadequacy. It has been my aim to furnish the practitioner with a useful and convenient treatise, embracing the latest statement Of the law and the most recent authorities; and I entertain a hope that its general usefulness may be largely augmented by the system and method I have pursued. Excerpt from A Treatise on Damages, Vol. 1 of 3: Covering the Entire Law of Damages, Both Generally and Specifically It is believed that every subject properly within the law of damages has been examined and treated in these three volumes. Matters which have seemed to the writers to be of peculiar or especial value, have been considered without regard to the fact whether or not the decisions covering them are few or numerous. Excerpt from A Treatise on the Law of Damages, Vol. 1: Embracing an Elementary Exposition of the Law and Also Its Application to Particular Subjects of Contract and Tort The American cases which have been reported in unofficial series of reports are referred to therein. These references and the new matter added to the text and notes represent about eight hundred pages. To make room for so much additional matter, it has been found necessary to condense somewhat a portion of the matter which appeared in the former edition. It is hoped that this has been done without serious detriment to the value of the work. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from Mayne's Treatise on Damages IT can hardly be necessary to apologise for the appearance of a treatise on Damages. The subject is certainly an important, and not a very easy one. The materials are scattered over all our reports, and many of our statutes. Yet, with the exception of the obsolete work by Serjeant Sayer, no English writer has ever thought of collecting them. The American treatise, by Professor Sedgwick, has gone far to supply this want. The great merits of his work are too well known to need any commendation from me. Its ability and research will be best appreciated by those who have studied it as minutely as I have done, and I gladly acknowledge the assistance which it has afforded me. It appeared to me, however, that there was still room for an English work upon the same subject. Many topics of im portance to the English practitioner are omitted by Mr. Sedgwick, partly through design, partly on account of the differences that have sprung up between the laws of the two countries. He has, also, naturally given a prominence to American cases, which is hardly satisfactory to us, oppressed as we are by the multitude of our own reports, and unwilling to extend our researches into unknown regions. Since the last edition of his treatise, our own Courts too have been remarkably prolific in decisions upon this branch of the law, and have supplied materials which well deserve a fresh attempt at classification. I have tried to collect every English case which bore upon the law of Damages; and have only resorted to American decisions, where none of our own were in point. Excerpt from Principles of the Law of Damages The general purpose of this new book on the law of Damages is like the purpose of the book on the law of Contracts by the same author, to give a complete treatise on the subject in a small volume. All the fundamental principles of the law of Damages are summarized in rules, or propositions of law. Explanations are given for these propositions of law, with reasons therefor, together with criticisms thereof, whenever in the judgment of the author the rules are the subject of criticism. In order to further elucidate the propositions, copious illustrations are given, showing the application of the same. Under such a plan it is hoped that anyone reading the book will obtain a thorough understanding of the law of Damages.
