Updated as of May 29, 2018 The Bureau of Consumer Financial Protection (Bureau) is amending Regulation Z, which implements the Truth in Lending Act (TILA). Regulation Z generally prohibits a creditor from making a mortgage loan unless the creditor determines that the consumer will have the ability to repay the loan. The final rule provides an exemption to these requirements for creditors with certain designations, loans pursuant to certain programs, certain nonprofit creditors, and mortgage loans made in connection with certain Federal emergency economic stabilization programs. The final rule also provides an additional definition of a qualified mortgage for certain loans made and held in portfolio by small creditors and a temporary definition of a qualified mortgage for balloon loans. Finally, the final rule modifies the requirements regarding the inclusion of loan originator compensation in the points and fees calculation. Updated as of May 29, 2018 This document amends the Department of Veterans Affairs (VA) Loan Guaranty regulations to implement provisions of the Dodd-Frank Wall Street Reform and Consumer Protection Act, requiring that VA define the types of VA loans that are "qualified mortgages" for the purposes of the new Ability to Repay provisions of the Truth in Lending Act. This rule establishes which VA-guaranteed loans are to be considered "qualified mortgages" and have either safe harbor protection or the presumption that the borrower is able to repay a loan, in accordance with the new Ability to Repay provisions. During the years preceding the mortgage crisis, too many mortgages were made to consumers without regard to the consumers' ability to repay the loans. Loose underwriting practices by some creditors - including failure to verify consumers' income or debts and qualifying consumers for mortgages based on "teaser" interest rates after which monthly payments would jump to unaffordable levels - contributed to a mortgage crisis that led to the nation's most serious recession since the Great Depression. Amid concerns that risky mortgage products and poor underwriting standards contributed to the recent housing crisis, Congress included mortgage reform provisions (qualified mortgage (QM) and qualified residential mortgage (QRM)) in the Dodd-Frank Wall Street Reform and Consumer Protection Act. The Consumer Financial Protection Bureau's (CFPB) regulations establishing standards for QM loans became effective in January 2014. More recently, six agencies jointly issued the final QRM rule that will become effective in December 2015. This book discusses views on the expected effects of the QM and QRM regulations, and examines the extent of agency planning for reviewing the regulations' effects, among its objectives.
