Arctic Marine Governance

The Arctic region plays an important role in regulating the world’s climate and is also highly impacted by climate change, with average temperatures rising almost twice as fast as the rest of the world and sea ice melting much faster than previously predicted. These rapid changes will have significant impacts on human activity in the region and on the Arctic marine environment. This book draws on the results of the 2008-2009 Arctic TRANSFORM project, funded by the European Commission‘s Directorate General of External Relations, which engaged experts in a transatlantic discussion on the roles of the European Union and United States in light of the Arctic’s changing climate and political and legal complexities. . The book addresses the significant changes and developments in the marine Arctic, with descriptions and recommendations reflecting the current governance environment. A comprehensive overview of environmental governance and sustainable development in the Arctic is created. Chapters explore impacts and activities by sector, looking at fisheries, shipping, and offshore hydrocarbon in the Arctic, and at policy options and strategies for improving marine governance in the region. A particular focus is given to the roles of the European Union and United States and opportunities for cooperation to enhance Arctic environmental governance. .

This book is based on presentations from the Conference ‘Arctic Marine Resource Governance’ held in Reykjavik Iceland in October 2015. The book is divided into four main themes: 1. Global management and institutions for Arctic marine resources 2. Resource stewards and users: local and indigenous co-management 3. Governance gaps in Arctic marine resource management and 4. Multi-scale, ecosystem-based, Arctic marine resource management’. The ecosystem changes underway in the Arctic region are expected to have significant impacts on living resources in both the short and long run, and current actions and policies adopted over such resource governance will have serious and ultimately irreversible consequences in the near and long terms.

The Arctic is particularly affected by climate change; over the past few decades, temperatures in this area have risen twice as fast as the mean global rate. The most prominent effect of global climate change in the region is the melting sea ice in the Arctic Ocean, which enables a multitude of ocean uses to be initiated and extended, such as shipping, fishing and oil and gas extraction. Unlike in the Antarctic, there is currently no single comprehensive legal regime for governance of the Arctic. Instead, the region is regulated by a patchwork of international treaties, above all the United Nations Convention on the Law of the Sea (UNCLOS), various regional and sub-regional agreements, national laws and soft-law agreements. This treatise provides an evaluation of the governance regime that regulates the use of the Arctic marine environment and its readiness to protect these fragile ecosystems in light of the consequences of climate change.

This open access book is a result of the Dalhousie-led research project Safe Navigation and Environment Protection, supported by a grant from the Ocean Frontier Institute’s the Canada First Research Excellent Fund (CFREF). The book focuses on Arctic shipping and investigates how ocean change and anthropogenic impacts affect our understanding of risk, policy, management and regulation for safe navigation, environment protection, conflict management between ocean uses, and protection of Indigenous peoples’ interests. A rapidly changing Arctic as a result of climate change and ice loss is rendering the North more accessible, providing new opportunities while producing impacts on the Arctic. The book explores ideas for enhanced governance of Arctic shipping through risk-based planning, marine spatial planning and scaling up shipping standards for safety, environment protection and public health.

Global energy problems will remain a challenge in the coming decades. The impact of climate change and the melting of polar sea ice opening up access to offshore hydrocarbon resources in the Arctic Ocean, raises questions for both civil society and the scientific community over drilling opportunities in Arctic marine areas. Disparities in approach to the governance of oil and gas extraction in the Arctic arise from fundamental differences in histories, cultures, domestic constraints and substantive values and attitudes in the Arctic coastal states and sub-states. Differing political systems, legal traditions and societal beliefs with regard to energy security and economic development, environmental protection, legitimacy of decision making, and the ownership and respect of the rights of indigenous people, all affect how governance systems of oil and gas extraction are designed. Using a multidisciplinary approach and case studies from the USA, Norway, Russia, Canada, Greenland/Denmark and the EU, this book both examines the current governance of extraction and its effects and considers ways to enhance the efficiency of environmental management and public participation in this system.

This book discusses to what extent the precautionary approach to fisheries management is reflected in the MSC Fisheries Standard and in the certification of four clusters of fisheries in polar waters. Certification according to private sustainability standards (ecolabelling) has become an important addition to public fisheries management in recent years. The major global ecolabel in terms of comprehensiveness and coverage is the Marine Stewardship Council (MSC) Fisheries Standard. Becoming and remaining certified requires continuous behavioural adaptation from fisheries through a fine-meshed system of improvement conditions attached to certification. Focus is on how certification has influenced fisher behaviour and state practice. In the Southern Ocean krill and toothfish fisheries, MSC certification has generated new scientific knowledge about the stocks. In the Barents Sea cod and haddock fisheries, fishing companies have voluntarily adapted their behaviour to reduce the fishery’s impacts on endangered, threatened and protected species and bottom habitats. In the local lumpfish fisheries in Greenland, Iceland and Norway, measures have been introduced to reduce the effects on seabirds and marine mammals. In the Northeast Atlantic mackerel fisheries, impacts have been more modest. Private certification is no panacea, but it seems to have found a niche as a supplement to national legislation and international agreements.
