Going beyond the more usual focus on Jerusalem as a sacred place, this book presents legal perspectives on the most important sacred places of the Mediterranean. The first part of the book discusses the notion of sacred places in anthropological, sociological and legal studies and provides an overview of existing legal approaches to the protection of sacred places in order to develop and define a new legal framework. The second part introduces the meaning of sacred places in Jewish, Christian and Islamic thought and focuses on the significance and role that sacred places have in the three major monotheistic religions and how best to preserve their religious nature whilst designing a new international statute. The final part of the book is a detailed analysis of the legal status of key sacred places and holy cities in the Mediterranean area and identifies a set of legal principles to support a general framework within which specific legal measures can be implemented. The book concludes with a useful appendix for the protection of sacred places in the Mediterranean region. This publication contains the text of the Council of Europe Framework Convention on the Value of Cultural Heritage for Society, which was adopted in October 2005. This Framework Convention is based on the idea that knowledge and the use of heritage form part of the citizen's right to participate in cultural life as defined in the Universal Declaration of Human Rights. Heritage is seen as a resource for human development, the enhancement of cultural diversity and the promotion of intercultural dialogue, and as part of an economic development model based on the principles of sustainable resource use. This volume offers a critical inquiry into the ever-evolving notion of cultural heritage and the way it has been made accessible, governed, and protected by the institutional, operational, and legal structures of the European Union.

This report analyses all aspects of cultural diversity, which has emerged as a key concern of the international community in recent decades, and maps out new approaches to monitoring and shaping the changes that are taking place. It highlights, in particular, the interrelated challenges of cultural diversity and intercultural dialogue and the way in which strong homogenizing forces are matched by persistent diversifying trends. Historic sites, memorials, national parks, museums...we live in an age in which heritage is ever-present. But what does it mean to live amongst the spectral traces of the past, the heterogeneous piling up of historic materials in the present? How did heritage grow from the concern of a handful of enthusiasts and specialists in one part of the world to something which is considered to be universally cherished? And what concepts and approaches are necessary to understanding this global obsession? Over the decades, since the adoption of the World Heritage Convention, various ‘crises’ of definition have significantly influenced the ways in which heritage is classified, perceived and managed in contemporary global societies. Taking an interdisciplinary approach to the many tangible and intangible ‘things’ now defined as heritage, this book attempts simultaneously to account for this global phenomenon and the industry which has grown up around it, as well as to develop a ‘toolkit of concepts’ with which it might be studied. In doing so, it provides a critical account of the emergence of heritage studies as an interdisciplinary field of academic study. This is presented as part of a broader examination of the function of heritage in late modern societies, with a particular focus on the changes which have resulted from the globalisation of heritage during the late twentieth and early twenty-first centuries. With disappearing music venues, and arts and culture communities at constant risk of displacement in our urban centers, the preservation of intangible cultural heritage is of growing concern to global cities. This book addresses the role and protection of intangible cultural heritage in the urban context. Using the methodology of Urban Legal Anthropology, the author provides an ethnographic account of the civic effort of Toronto to become a Music City from 2014-18 in the context of redevelopment and gentrification pressures. Through this, the book elucidates the problems cities like Toronto have in equitably protecting intangible cultural heritage and what can be done to address this. It also evaluates the engagement that Toronto and other cities have had with international legal frameworks intended to protect intangible cultural heritage, as well as potential counterhegemonic uses of hegemonic legal tools. Understanding urban intangible cultural heritage and the communities of people who produce it is of importance to a range of actors, from urban developers looking to formulate livable and sustainable neighbourhoods, to city leaders looking for ways in which their city can flourish, to scholars and individuals concerned with equitability and the right to the city. This book is the beginning of a conservation about what is important for us to protect in the city for future generations beyond built structures, and the role of intangible cultural heritage in the creation of full and happy lives.
