Competition Or Convergence

The telecommunications industry has experienced dynamic changes over the past several years, and those exciting events and developments are reflected in the chapters of this volume. The Telecommunications Policy Research Conference (TPRC) holds an unrivaled place at the center of national public policy discourse on issues in communications and information. TPRC is one of the few places where multidisciplinary discussions take place as the norm. The papers collected here represent the current state of research in telecommunication policy, and are organized around four topics: competition, regulation, universal service, and convergence. The contentious competition issues include bundling as a strategy in software competition, combination bidding in spectrum auctions, and anticompetitive behavior in the Internet. Regulation takes up telephone number portability, decentralized regulatory decision making versus central regulatory authority, data protection, restrictions to the flow of information over the Internet, and failed Global Information Infrastructure initiatives. Universal service addresses the persistent gap in telecommunications from a socioeconomic perspective, the availability of competitive Internet access service and cost modeling. The convergence section concentrates on the costs of Internet telephony versus circuit switched telephony, the intertwined evolution of new services, new technologies, and new consumer equipment, and the politically charged question of asymmetric regulation of Internet telephony and conventional telephone service.

Driven by the fascination about dramatic structural and competitive changes within telecommunication and information technology in dustries during the past decade, the convergence phenomenon has increasingly gained my personal attention throughout my work and studies. Therefore, not entirely coincidentally, this book was written as the result of my doctoral research at ETH Zurich, which turned out to be a challenging, yet highly rewarding endeavor. However, this work would not have been possible without the enduring support of several people. First, I would like to express my gratitude to my thesis supervisor Prof. Fritz Fahrni, for providing me with the opportunity to conduct exciting research projects in close collaboration with industry, and for supporting me with solid guidance and advice all the way. Also, I would like to thank Dr. Christian Marxt, for urging me to pursue the chosen line of enquiry, as well as for his devoted coaching, both at ETH and at Stanford, both within and beyond of?ce hours. The international dimensions of competition law and policy are most often examined at the level of substantive law. In this legal area both intentional and spontaneous assimilation and harmonization trends can be recognized, which manifest themselves e.g. in comparable approaches to combating particularly harmful restraints (so-called "hardcore cartels"). However, the complex terrain of enforcement law has been mainly ignored up to date. Are there common approaches in this field as well? How are the various competition laws linked with each other in respect to procedural norms? This book conceptualizes "International Competition Enforcement Law" against the backdrop of these issues and at the level of comparative law. The ciphers "cooperation" and "convergence" will serve as the two principle ideas for this book.

This book examines the coordination of renewable energy policies in the European Union using an innovative theoretical approach to explain national policy making. David Jacobs asks, why are national support instruments for electricity from renewable energy sources converging, even though the harmonisation of these frameworks at the European level has failed? Which causal mechanisms lead to cross-national policy similarities? And what are the implications for policy coordination in the EU? The author traces the evolution of feed-in tariffs - the most successful and most widely used support mechanism for renewable electricity - in Germany, Spain and France. He reveals increasing cross-national policy similarities in feed-in tariff design - despite the failure of harmonizing instruments at the European level. He explains these increasing policy similarities by applying policy convergence theory. Policy convergence can occur voluntarily, based on transnational communication, regulatory competition and technological innovations and these findings have important implications for European policy steering. The key to this book is the interrelation of an innovative theoretical concept (coordination of policies in the international arena via voluntary cooperation) with a very topical empirical research focus - the promotion of renewable energies in the EU. It will be essential reading for scholars and students of environmental policy, comparative politics and European studies.

The inspiration for this volume of essays is a British-German conference held in 1998 in Rauischholzhausen Castle near Giessen (Germany). 15 authors from the United Kingdom and Germany deal with problems of competition and convergence of European legal systems in the context of important fields of law, for example Constitutional Law and the law of ethnic minorities, Criminal Law, Telecommunication Law, Contract Law, Securities, Law of Employment, Law of Procedure and Health Law.

A fresh analysis of policy convergences across nations, which identifies their key driving forces. To what extent and in which direction can we empirically observe a convergence of national policies? In which areas and for which patterns of policy is convergence more or less pronounced? This text addresses these central questions with clarity and rigour. With growing economic and institutional interlinkages between nation states, it is often assumed that there is an overall trend towards increasingly similar policies across countries. Comparative research on the domestic impact of globalization and European integration, however, reveals that policy convergence can hardly be considered as a dominant and uniform tendency which can be taken for granted. Although a number of factors have been suggested in order to account for the rather mixed empirical picture, we still have limited knowledge about the causes and conditions of cross-national policy convergence. In particular, the central mechanisms and conditions affecting both degree and level of cross-national policy convergence are yet not well understood. This book will be of great interest to all students and scholars of the European Union, European politics, and international relations. This is a special issue of the leading Journal of European Public Policy.
