Au courant de l'annee rg6r le mecanisme de protection des droits de l'homme institue par la Convention a, pour la premiere fois, fonctionne dans son integralite. La Commission, la Cour et le Comite des Ministres ont, en effet, exerce les fonctions que leur assigne la Convention. Les juristes suivent, depuis 1955 deja, la jurisprudence de la Commission qui apporte une importante contribution au droit international general. L'annee rg6r leur fournit une plus ample matiere avec le premier arret sur le fond jamais rendu dans le domaine des droits de l'homme par un tribunal international. C'est le rer juillet rg6r que la Cour europeenne des Droits de l'Homme a prononce son arret dans l'affaire Lawless, mettant ainsi fin au litige introduit devant la Commission par un particulier contre son propre gouvernement. A cet arret vient s'ajouter la decision prise dans l'affaire Nielsen par le Comite des Ministres du Conseil de l'Europe le 25 octobre rg6r.

This book is the result of a 4-year research project conducted at the Faculty of Law of the University of Luxembourg. It explores the legal value and enforceability of tax circulars and tax rulings in Luxembourg domestic law in light of the principle of legitimate expectations and related principles. After studying the historical roots of both interpretative acts, this research questions the level of protection taxpayers enjoy when relying on circulars and tax rulings and contains a review of decades of administrative case-law to assess the judicial discourse on taxpayers’ rights to certainty. This book further investigates the case of circulars and tax rulings that contain interpretations of tax laws that are contrary to the law (contra legem) and builds upon the existing normative framework to introduce proposals addressing issues of uncertainty and inequality taxpayers are likely to suffer when relying on such interpretative acts. This volume of the "Yearbook of the European Convention on Human Rights, prepared by the Directorate of Human Rights of the Council of Europe, relates to 2003. Part one contains information on the Convention. Part two deals with the control mechanism of the European Convention on Human Rights: selected judgments of the European Court of Human Rights and human rights (DH) resolutions of the Committee of Ministers; part three groups together the other work of the Council of Europe in the field of human rights, and includes the work of the Committee of Ministers, the Parliamentary Assembly and the Directorate General of Human Rights; part four is devoted to information on national legislation and extracts from national judicial decisions concerning rights protected by the Convention. Appendix A contains a bibliography on the Convention, and Appendix B the biographies of the new judges elected to the European Court of Human Rights.

Les contributions regroupées dans cet ouvrage visent à comprendre les relations et influences à travers le temps entre l’Europe et les États-Unis. S’il existe des différences importantes entre le modèle de société américain et européen, si à certains moments de notre histoire, même récente, des divergences sont apparues, il est essentiel de rappeler les multiples convergences entre ces deux continents. Le couple euro-américain n’est pas un mythe et les évolutions géopolitique et géoéconomique futures ne devraient que l’inciter à approfondir et à intensifier les relations transatlantiques. Outre l’importance de l’objet d’étude traité, cet ouvrage produit une analyse pluridisciplinaire essentielle à la compréhension du sujet et s’appuie sur des auteurs ayant un regard multiculturel. The contributions gathered in this volume seek to understand the relations and influences across time between Europe and the United States. If there are significant differences between the model of American and European society, if at some point in our history, even recent, some divergences emerged, it is important to remember the numerous similarities between these two continents. Euro-American couple is not a myth and the future geopolitical and geo-economic developments should encourage them to deepen and strengthen transatlantic relations. Besides the importance of the treated study topic, this work supplies a multidisciplinary analysis, essential to the understanding of the subject and is based on authors having a multicultural view.
