"New research on urban air pollution casts doubt on the conventional view of the relationship between economic growth and environmental quality. This view holds that pollution automatically increases until societies reach middle-income status because poor countries have neither the institutional capacity nor the political commitment necessary to regulate polluters. Some policymakers and researchers have cited this model (called the "environmental Kuznets curve," or EKC) when arguing that developing countries should "grow first, clean up later." However, new evidence suggests that the EKC model is misleading because it mistakenly assumes that strong environmental governance is not possible for poor countries. As the authors show in this paper, the empirical relationship between pollution and income becomes much weaker when measures of governance are added to the analysis. Their results also suggest that previous research has underestimated the effect of geographic vulnerability (climate and terrain factors) on air quality. The authors find that weak governance and geographic vulnerability alone can account for the crisis levels of air pollution in many developing country cities. When these factors are combined with income and population effects, the authors have a sufficient explanation for the fact that some cities already have air quality comparable to levels in OECD urban areas. To summarize, their results suggest that the maxim "grow first, clean up later" is too simplistic. Appropriate urban growth strategies can steer development toward cities with lower geographic vulnerability, and governance reform can reduce air pollution significantly, long before countries reach middle-income status. This book systematically analyzes how and why China has expectedly lost and then surprisingly gained ground in the quest to solve the complicated environmental problem of air pollution over the past two decades. Yuan Xu shines a light on how China’s sulfur dioxide emissions rose quickly in tandem with rapid economic growth but then dropped to a level not seen for at least four decades. Despite this favorable mitigation outcome, Xu details how this stemmed from a litany of policy stumbles within the Chinese context of no democracy and a lack of sound rule of law. Throughout this book, the author examines China’s environmental governance and strategy and how they shape environmental policy. The chapters weave together a goal-centered governance model that China has adopted of centralized goal setting, decentralized goal attainment, decentralized policy making and implementation. Xu concludes that this model provides compelling evidence that China’s worst environmental years reside in the past. The Federal Clean Air Act of 1970 is widely seen as a revolutionary legal response to the failures of the earlier common law regime, which had governed air pollution in the United States for more than a century. Noga Morag-Levine challenges this view, highlighting striking continuities between the assumptions governing current air pollution regulation in the United States and the principles that had guided the earlier nuisance regime. Most importantly, this continuity is evident in the centrality of risk-based standards within contemporary American air pollution regulatory policy. Under the European approach, by contrast, the feasibility-based technology standard is the regulatory instrument of choice. Through historical analysis of the evolution of Anglo-American air pollution law and contemporary case studies of localized pollution disputes, Chasing the Wind argues for an overhaul in U.S. air pollution policy. This reform, following the European model, would forgo the unrealizable promise of complete, perfectly tailored protection--a hallmark of both nuisance law and the Clean Air Act--in favor of incremental, across-the-board pollution reductions. The author argues that prevailing critiques of technology standards as inefficient and undemocratic instruments of "command and control" fit with a longstanding pattern of American suspicion of civil law modeled interventions. This distrust, she concludes, has impeded the development of environmental regulation that would be less adversarial in process and more equitable in outcome.

The successful reduction of urban air pollution is among the notable achievements of modern environmental law and policy. This remarkable study, focusing on two of the world’s most prominent cases, explores how people in the areas of Los Angeles and Beijing-Tianjin-Hebei (BTH) established governance processes to combat air pollution and how the major actors in each area worked to make their region a better place to live. Employing the expertise of teams of knowledgeable environmental law experts from both China and the United States, the authors identify and analyze similarities and differences in the respective legal and policy experiences as actors succeeded in greatly improving the air quality of their areas. Underpinned by a model of environmental governance developed by the authors and presenting an abundance of first-hand information from both areas, the study finds that, despite broad political and cultural differences in both regions, three political relations in governance processes emerge as enablers of effective reduction of air pollution: relation between regulators and the regulated communities; relation between all the supervisory political entities, such as legislatures, etc., and regulators; and relation between civil society (including news media and nongovernmental organizations) and polluters. Specific areas of regulation covered include transportation, ports, energy efficiency, utilities, oil refineries, building efficiency, renewable energy, coal dependency, and optimizing energy structure. With its sound, replicable model, its solid findings, and its enlightening conclusions, this incomparable work will prove of immeasurable value to administrative authorities and counsel worldwide engaged in combating air pollution. Moreover, its creative methodology is a signal contribution to the comparative study of environmental law and policy.
