Home to Ellis Island, New Jersey has been the first stop for many immigrant groups for well over a century. Yet in this highly diverse state, some of the most anti-immigrant policies in the nation are being tested. American suburbs are home to increasing numbers of first and second-generation immigrants who may actually be bypassing the city to settle directly into the neighborhoods that their predecessors have already begun to plant roots in—a trajectory that leads to nativist ordinances and other forms of xenophobia. In Lady Liberty’s Shadow examines popular white perceptions of danger represented by immigrants and their children, as well the specter that lurks at the edges of suburbs in the shape of black and Latino urban underclasses and the ever more nebulous hazard of (presumed-Islamic) terrorism that threatening to undermine “life as we know it.” Robyn Magalit Rodriguez explores the impact of anti-immigrant municipal ordinances on a range of immigrant groups living in varied suburban communities, from undocumented Latinos in predominantly white suburbs to long-established Asian immigrants in “majority-minority” suburbs. The “American Dream” that suburban life is supposed to represent is shown to rest on a racialized, segregated social order meant to be enjoyed only by whites. Although it is a case study of New Jersey, In Lady Liberty’s Shadow offers crucial insights that can shed fresh light on the national immigration debate. However, this shift was not always accompanied by liberation from restrictive practices. In 2014 a UK Supreme Court ruling on the meaning of ‘deprivation of liberty’ resulted in large numbers of older and disabled people in care homes, supported living and family homes being re-categorized as ‘detained’. Placing this ruling in its social, historical and global context, this book presents a socio-legal analysis of social care detention in the post-carceral era. Drawing from disability rights law and the meanings of ‘home’ and ‘institution’ it proposes solutions to the Cheshire West ruling’s paradoxical implications.

An instant New York Times bestseller: An acclaimed legal scholar’s “important” (New York Times) and “fascinating” (Economist) exposé of how the Supreme Court uses unsigned and unexplained orders to change the law behind closed doors. The Supreme Court has always had the authority to issue emergency rulings in exceptional circumstances. But since 2017, the Court has dramatically expanded its use of the behind-the-scenes “shadow docket,” regularly making decisions that affect millions of Americans without public hearings and without explanation, through cryptic late-night rulings that leave lawyers—and citizens—scrambling. The Court’s conservative majority has used the shadow docket to green-light restrictive voting laws and bans on abortion, and to curtail immigration and COVID vaccine mandates. But Americans of all political stripes should be worried about what the shadow docket portends for the rule of law, argues Supreme Court expert Stephen Vladeck. In this rigorous yet accessible book, he issues an urgent call to bring the Court back into the light.

Penelope Anderson's original study changes our understanding both of the masculine Renaissance friendship tradition and of the private forms of women's friendship of the eighteenth century and after. It uncovers the latent threat of betrayal lurking within politicized classical and humanist friendship, showing its surprising resilience as a model for political obligation undone and remade. Incorporating authors from Cicero to Abraham Cowley and Margaret Cavendish to Mary Astell, the book focuses on two extraordinary women writers, the royalist Katherine Philips and the republican Lucy Hutchinson. And it explores the ways in which they appropriate the friendship tradition in order to address problems of conflicting allegiances in the English Civil Wars and Restoration. As Penelope Anderson suggests, their writings on friendship provide a new account of women's relation to public life, organized through textual exchange rather than bodily reproduction.

Since 1996, when new, harsher deportation laws went into effect, the United States has deported millions of noncitizens back to their countries of origin. While the rights of immigrants-with or without legal status--as well as the appropriate pathway to legal status are the subject of much debate, hardly any attention has been paid to what actually happens to deportees once they "pass beyond our aid." In fact, we have fostered a new diaspora of deportees, many of whom are alone and isolated, with strong ties to their former communities in the United States. Daniel Kanstroom, author of the authoritative history of deportation, Deportation Nation, turns his attention here to the current deportation system of the United States and especially deportation's aftermath: the actual effects on individuals, families, U.S. communities, and the countries that must process and repatriate ever-increasing numbers of U.S. deportees. Few know that once deportees have been expelled to places like Guatemala, Cambodia, Haiti, and El Salvador, many face severe hardship, persecution and, in extreme instances, even death. Addressing a wide range of political, social, and legal issues, Kanstroom considers whether our deportation system "works" in any meaningful sense. He also asks a number of under-examined legal and philosophical questions: What is the relationship between the "rule of law" and the border? Where do rights begin and end? Do (or should) deportees ever have a "right to return"? After demonstrating that deportation in the U.S. remains an anachronistic, ad hoc, legally questionable affair, the book concludes with specific reform proposals for a more humane and rational deportation system.
