This book provides a systemic understanding of how intangible cultural heritage (ICH) can promote sustainable development. It offers new insights on the identity-building potential of heritage practices as ‘enabler’ of development and their capacity to generate social and economic profits as ‘driver’ of development. Based on Pierre Bourdieu’s ‘Theory of Practice’, a model for the valorisation of ICH is presented, which may serve as a tool to stimulate the developmental potentials of heritage on a practical level. The functioning of the valorisation model is exemplified with a case study on a German choral tradition, which has not been officially nominated as ICH. Therewith, it is shown how the model can be applied to utilise the developmental potentials of ICH - as promoted in the Convention for the Safeguarding of the Intangible Cultural Heritage (2003) – even beyond UNESCO’s scope. This book is of interest to cultural heritage scholars.

Drawing on debates about intangible cultural heritage (ICH) safeguarding at the local and international levels, Intangible Cultural Heritage and Sustainable Development: Inside a UNESCO Convention, explores the theoretical and practical implications of the intertwinement between these policy fields. Considering how sustainable development (SD) priorities are influencing representations of ICH, the volume questions how they are expanding the frontiers of the heritage realm and unsettling accepted understandings of the social uses of heritage. The contributing authors, who hail from a variety of different contexts and disciplinary backgrounds, explore these issues from a unique vantage point as both scholars and actors of the processes they analyze. The importance of cultural heritage - in both its tangible and intangible forms - to sustainable development and its economic, social and environmental components is increasingly evident in the recent practice of intergovernmental and non-governmental organizations at the universal and regional level. Due consideration for the integration of the cultural dimension in the implementation of Agenda 2030 has begun to grow in various international fora, including initiatives to emphasize the role and contribution of tangible and intangible heritage as drivers and enablers of sustainable development. It has also been recognized that the inherent links between cultural heritage and sustainable development cannot be correctly addressed without taking into account their various implications for the effective enjoyment of all human rights, including cultural rights. This book offers a thorough academic investigation on the importance of cultural heritage to sustainable development and cultural rights from an international law perspective. Providing an in-depth review of the possible intersections between cultural heritage, sustainable development and cultural rights and the limits of the current legal and institutional framework, it will be of interest to researchers and scholars of international law, cultural heritage law, environmental law and human rights law.

Intangible Cultural Heritage (ICH) has recently grown as an analytical construct for documenting and interpreting culture, and as a canonical term to support official concepts of heritage. ICH, while compelling scholars to explore its multiple forms of expressive culture, has become codified through UNESCO, specifically within the 2003 Convention for the Safeguarding of ICH. This volume explores case studies from Gabon, India, Mozambique, Sri Lanka, and the USA to represent diverse positionalities and voices articulating the complexities, ambiguities and uncertainties within heritage discourses. The chapters illustrate how ICH, in the midst of the COVID-19 pandemic, has become an analytical resource and a proscriptive device for safeguarding, presenting, and interpreting culture to a range of constituents, and will serve as a useful resource in the classroom for a range of fields, as well as for scholars and practitioners.

This book critically analyses the relationships between intangible cultural heritage (ICH), sustainable development and intellectual property rights (IPRs). The author argues that although the use of IPRs to safeguard ICH presents challenges and has impeded sustainable development in some cases, the adoption of these rights on ICH also presents opportunities and, fundamentally, is not contrary to the spirit of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (UNESCO 2003 Convention). The adoption of IPRs on ICH can form an important part of the development of sustainable safeguarding plans capable of benefitting the communities, groups and individuals (CGIs) that create, maintain and transmit such heritage. The book provides a nuanced analysis of the relationship between intellectual property (IP) law and ICH as well as examining the role of IPRs in safeguarding ICH through the lens of sustainable development. It analyses the relationship between IP law and ICH from environmental, social and economic perspectives. These perspectives allow a thorough evaluation of both the positive effects and potential pitfalls of adopting IPRs to safeguard ICH. The book addresses deeper structural matters that refer back to the safeguarding of social and environmental processes underlying ICH.

The Sustainable Development Goals (SDGs) adopted by the UN in 2015 have influenced the actions of international and intergovernmental organisations and governments around the world, and have dictated priorities for international aid spending. Culture, including heritage, is often presented as fundamental to addressing the SDGs: since 2010, the United Nations has adopted no fewer than five major policy recommendations that assert its importance as a driver and enabler of development. Yet, heritage is marginalized from the Sustainable Development Goals. Rethinking Heritage for Sustainable Development constitutes a substantial and original assessment of whether and how heritage has contributed to three key dimensions of sustainable development (namely poverty reduction, gender equality and environmental sustainability) within the context of its marginalisation from the Sustainable Development Goals and from previous international development agendas. Sophia Labadi adopts a novel, inclusive, large-scale and systematic approach, providing the first comprehensive history of the international approaches on culture (including heritage) for development, from 1970 to the present day. This book is also the first to assess the negative and positive impacts of all the international projects implemented in sub-Saharan Africa by a consortium of UN organisations that aimed to provide evidence for the contribution of heritage for development in time for the negotiation of the SDGs. The book’s conclusions provide recommendations for rethinking heritage for development, while reflecting on the major shortcomings of the selected projects.

The intangible cultural heritage (ICH) of the world's communities is an inheritance that has been passed down through many generations. Its survival, however, is increasingly threatened by the realities of post-modern society, such as rapid urbanisation, large-scale migration, severe environmental change and globalisation. In 2003, the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage recognised the importance of ICH, both as a mainspring of cultural diversity and a source of sustainable development. Early efforts to implement the convention are bringing to light issues that are crucial to the survival of ICH. Many of these involve its interaction with intellectual property law. To clarify the relationship between these two fields, the present volume gathers the views of scholars and practitioners with diverse expertise and national backgrounds. They examine four main issues: the construction and operation of ICH inventories; the conceptualisation of the “community” as a holder of ICH; how to obtain the community's prior informed consent; and the pros and cons of various regulatory regimes. Despite the variety in the contributions, the common thread in the book is the authors' belief that regulatory regimes must be designed so that ICH will not only be safeguarded in archives and museums but also in its living form.
