This book provides a systemic understanding of how intangible cultural heritage (ICH) can promote sustainable development. It offers new insights on the identity-building potential of heritage practices as ‘enabler’ of development and their capacity to generate social and economic profits as ‘driver’ of development. Based on Pierre Bourdieu’s ‘Theory of Practice’, a model for the valorisation of ICH is presented, which may serve as a tool to stimulate the developmental potentials of heritage on a practical level. The functioning of the valorisation model is exemplified with a case study on a German choral tradition, which has not been officially nominated as ICH. Therewith, it is shown how the model can be applied to utilise the developmental potentials of ICH - as promoted in the Convention for the Safeguarding of the Intangible Cultural Heritage (2003) – even beyond UNESCO’s scope. This book critically analyses the relationships between intangible cultural heritage (ICH), sustainable development and intellectual property rights (IPRs). The author argues that although the use of IPRs to safeguard ICH presents challenges and has impeded sustainable development in some cases, the adoption of these rights on ICH also presents opportunities and, fundamentally, is not contrary to the spirit of the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (UNESCO 2003 Convention). The adoption of IPRs on ICH can form an important part of the development of sustainable safeguarding plans capable of benefitting the communities, groups and individuals (CGIs) that create, maintain and transmit such heritage. The Sustainable Development Goals (SDGs) adopted by the UN in 2015 have influenced the actions of international and intergovernmental organisations and governments around the world, and have dictated priorities for international aid spending. Culture, including heritage, is often presented as fundamental to addressing the SDGs: since 2010, the United Nations has adopted no fewer than five major policy recommendations that assert its importance as a driver and enabler of development. Yet, heritage is marginalized from the Sustainable Development Goals. Rethinking Heritage for Sustainable Development constitutes a substantial and original assessment of whether and how heritage has contributed to three key dimensions of sustainable development (namely poverty reduction, gender equality and environmental sustainability) within the context of its marginalisation from the Sustainable Development Goals and from previous international development agendas. Sophia Labadi adopts a novel, inclusive, large-scale and systematic approach, providing the first comprehensive history of the international approaches on culture (including heritage) for development, from 1970 to the present day. The intangible cultural heritage (ICH) of the world's communities is an inheritance that has been passed down through many generations. Its survival, however, is increasingly threatened by the realities of post-modern society, such as rapid urbanisation, large-scale migration, severe environmental change and globalisation. In 2003, the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage recognised the importance of ICH, both as a mainspring of cultural diversity and a source of sustainable development. Early efforts to implement the convention are bringing to light issues that are crucial to the survival of ICH. Many of these involve its interaction with intellectual property law. To clarify the relationship between these two fields, the present volume gathers the views of scholars and practitioners with diverse expertise and national backgrounds. They examine four main issues: the construction and operation of ICH inventories; the conceptualisation of the “community” as a holder of ICH; how to obtain the community's prior informed consent; and the pros and cons of various regulatory regimes. Despite the variety in the contributions, the common thread in the book is the authors' belief that regulatory regimes must be designed so that ICH will not only be safeguarded in archives and museums but also in its living form.
