International Wildlife Law

This is the first major description of the international law protecting wildlife, covering the International Conventions on, among other matters: whaling; wetlands; protection of cultural and natural heritage; international trade in endangered species; Antarctic marine living resources.

The development of international wildlife law has been one of the most significant exercises in international law-making during the last fifty years. This second edition of Lyster's International Wildlife Law coincides with both the UN Year of Biological Diversity and the twenty-fifth anniversary of Simon Lyster's first edition. The risk of wildlife depletion and species extinction has become even greater since the 1980s. This new edition provides a clear and authoritative analysis of the key treaties which regulate the conservation of wildlife and habitat protection, and of the mechanisms available to make them work. The original text has also been significantly expanded to include analysis of the philosophical and welfare considerations underpinning wildlife protection, the cross-cutting themes of wildlife and trade, and the impact of climate change and other anthropogenic interferences with species and habitat. Addressing the interests of non-human animals in an era of globalization requires consideration of a wide range of international influences upon domestic case law, policy, and legal doctrine. International agreements and decisions affect much more than simple cross-border transactions in animals or animal-related products and can also impact what individual countries may or may not do internally to address animal cruelty, health, consumer protection interests, cultural preservation, conservation, species preservation, and a host of other issues in their national laws and regulations. For the first time, materials from a variety of sources are brought together in a single volume which permits instructors and students to focus directly on the complex interaction which occurs between domestic animal law and various international regimes. The plight of animal individuals and species inflicted on them by human activity is a global problem with detrimental repercussions for all humans and for the entire planet. This book gives an overview of the most important international legal regimes that directly address and indirectly affect animals. It covers species conservation treaties, notably the international whaling regime, the farm animal protection rules of the EU, international trade law and the international law of armed conflict. It also analyses the potential for an international regime of animal rights. Finding that international law creates more harm than good for animals, the auther suggests progressive treaty interpretation, treaty making and animal interest representation to close the animal welfare gap in international law. A body of global animal law needs to be developed, accompanied by critical global animal studies.

In recent years, many countries have significantly revised their existing legislation or adopted new legal frameworks for the protection and management of wildlife. This study assesses the current status of national wildlife laws around the world, with a particular emphasis on legal innovations that have emerged over the last decade. The study focuses on domestic legislation, but also briefly examines the main features of international wildlife treaties, highlighting the linkages between global, national and local instruments. While retaining many of the basic elements of earlier legislation, recent laws address new issues and reflect new strategies for wildlife protection and management. They provide for better protection of biodiversity, deal with broader threats to wildlife within and outside protected areas, place clearer emphasis on management planning, pay more attention to sociocultural dimensions of wildlife management, enhance the involvement of affected persons and stakeholders in decision-making, and allow greater scope for local communities to participate in the benefits of wildlife use.
