The Second Edition of Monopoly, Competition and the Law is a rigorous and detailed exposition of the objectives, nature and application of competition law in the United Kingdom, the EEC and the USA. Fully updated, it includes a full account of the many legal developments since 1989, including analyses of the new merger policy of the EEC and proposals for the radical reform of UK policy of restrictive trade practices. This work is the most recent of its kind, providing updated coverage of this dynamic area of law and policy which has become an everyday consideration in market strategy. Tim Frazer, a specialist in competition law and policy and a solicitor, surveys the vast and complex field of monopoly and competition policy in a style easily accessible to lawyers and non-lawyers alike. Every aspect of the law, in all three jurisdictions, is covered - the development of governmental and judicial policy on monopoly and competition; the objectives of competition policy and the legal control of business practices; monopoly and competition laws in the UK, the EEC and the USA, with an examination of the legal and economic problems involved. Lawyers, economists, political and social scientists will find this an informative reference source on a wide range of topics, including concepts of public policy, the nature and treatment of unfair and discriminatory practices, and the role of the government in the market place. An indispensable text for all students and practitioners of competition law and policy, this comprehensive survey is also highly relevant to industrial economics, commercial and business law, contract law and consumer protection.

This book collects some of the author's most illuminating recent papers on competition policy published since the turn of the millennium. They focus on three main themes: how technological innovation leads to monopolistic market structures and is reciprocally influenced by them; how competition agencies deal with the links from merger to economic efficiency, static and dynamic; and the behavioral problems posed by 'tacit' collusion and monopoly power in vertical market chains. Taken together they provide unique insight into competition, mergers and monopolies from one of the leading pioneers in the field.

The innovative contributions of the Italian Marginalists - Pareto, Pantaleoni, De Viti de Marco and Barone, to economic theory have previously been overlooked. This is the first book to deal with the history of the theory of market power and of its relation with competition, focusing on the distinct intellectual tradition that is Italian Marginalist economic thought. Monopoly Power and Competition is a vital resource for historians of economic thought, as it explores a relatively untouched area of microeconomics that sheds light on the theories surrounding monopoly power and barriers to entry.

The China Anti-Monopoly Law (AML), which became effective August 1, 2008, is the first comprehensive competition law enacted by China. The AML prohibits a broad array of agreements between competitors and commercial counterparties, as well as competitive conduct by single firms that may harm the competitive process. In addition, it establishes a mandatory administrative review procedure for mergers and acquisitions between companies meeting certain sales thresholds, globally or in China. Beyond these fundamental provisions, the AML prohibits certain types of administrative abuses believed to be prevalent in China and establishes a complex set of administrative agencies with broad powers to enforce the law. Anti-Monopoly Law and Practice in China is the first comprehensive treatment of the AML and the practice of antitrust law under this new system. Each chapter on the substantive provisions of the law includes practical advice on approaches to meeting the challenge of complying with the law's requirements, including analysis of likely interpretations and applications of the AML based on precedents in related economic laws and actions by other administrative agencies. Where policy choices are uncertain, the text will explore probable developments in China based on comparable applications of competition laws in other jurisdictions.

This book focuses on experiences with the Anti-Monopoly Law (AML) of 2007 in China. It uses carefully-chosen case studies to examine how the competition authorities in China discuss cases and how they use economic reasoning in their decision-making process. Bringing together comparative perspectives, the expert contributors discuss the practice of the Anti-Monopoly Law in China from the viewpoints of European and American competition policy. Several very current topics are given specific attention, including enforcement, the role of the state, how to define the relevant market and how to apply the AML to regulated industries. The book also indicates the scope for mutual learning on how to improve the AML. The Chinese Anti-Monopoly Law will appeal to competition lawyers, attorneys-at-law dealing with economic law generally, civil servants and policy makers, comparative lawyers and social scientists with an interest in developments in China.
