Natural Resource Governance And Human Rights And Human Security Implication

The management of natural resources is directly related to livelihoods for local communities, but is also intimately linked to broader national and regional economic development, as well as to political stability, peace and security. Natural resources and their effective management are necessary for securing the realisation of human rights. While there is some analysis regarding the emergence of specific relevant areas of human rights, such as the right to water, the right to food, or public participation, there is no systematic and comprehensive study on the potential role that human rights law can play in the management of natural resources. This book provides an in-depth analysis of these developments and how these could contribute to a more comprehensive human rights-based approach to the management of natural resources. In doing so, the author proposes a systematic analysis of the different norms, procedures, and approaches developed under human rights law which are relevant to the management of natural resources. As such, the text offers a human rights-based approach to the development of a legal framework for natural resource management, an area which is currently dominated by investment law and treaties concerning the use and exploitation of natural resources by States and private actors.

This book argues that a set of persuasive narratives about the links between natural resource, armed conflict and peacebuilding have strongly influenced the natural resource interventions pursued by international peacebuilders. The author shows how international peacebuilders active in Liberia and Sierra Leone pursued a collective strategy to transform “conflict resources” into “peace resources” vis-à-vis a policy agenda that promoted “securitization” and “marketization” of natural resources. However, the exclusive focus on securitization and marketization have been counterproductive for peacebuilding since these interventions render invisible issues connected to land ownership, environmental protection and sustainable livelihoods and mirror pre-war governing arrangements in which corruption, exclusion and exploitation took root. Natural resource governance and peacebuilding must go beyond narrow debates about securitization and marketization, and instead be a catalyst for trust–building and cooperation that has a local focus, and pursues an inclusive agenda that not only serves the cause of peace, but the cause of people.

Societies around the world face an increasingly uncertain future as social and ecological changes create pressure on resource governance, and this uncertainty calls for new models that illuminate the intersections of civil society, public sector, and private sector resource management. This volume presents a diversity of collaborations between various governance actors in the management of the Food-Energy-Water (FEW) nexus. It analyses the ability of emergent governance structures to cope with the complexity of future challenges across FEW systems. Divided into two sections, chapters in the first half of the book present a collection of case studies from around the world exemplifying how FEW nexus challenges are addressed in a multitude of ways and by a variety of actors. Chapters in the second half offer broader perspectives on the management of FEW and underline the lessons that emerge from applying a FEW lens to the question of natural resource governance. The varied examples in this book highlight that the management of FEW is often a question of reinventing, adapting, and building upon existing practices. Such practices are deeply embedded in unique socio-cultural, environmental, and political contexts as well as ‘hard’ infrastructures.
