Technological advances in noninvasive neuroimaging, neurophysiology, genome sequencing, and other methods together with rapid progress in computational and statistical methods and data storage have facilitated large-scale collection of human genomic, cognitive, behavioral, and brain-based data. The rapid development of neurotechnologies and associated databases has been mirrored by an increase in attempts to introduce neuroscience and behavioral genetic evidence into legal proceedings. In March 2018, the National Academies of Science, Engineering and Medicine organized a workshop in order to explore the current uses of neuroscience and bring stakeholders from neuroscience and legal societies together in both the United Kingdom and the United States. Participants worked together to advance an understanding of neurotechnologies that could impact the legal system and the state of readiness to consider these technologies and where appropriate, to integrate them into the legal system. This publication summarizes the presentations and discussions from the workshop.

"Discussions around the intersection between neuroscience and the law began decades ago. Originally used mostly in death penalty cases, the role of neuroscience has extended to cases involving drugs, assault, burglary, child abuse, rape, fraud, theft, and kidnapping. Neuroscience has also begun to play an increasingly important role in making policy, particularly where the law is unclear or ambiguous. In the early modern period, poetic form underpinned and influenced scientific progress. The language and imagery of seventeenth-century writers and natural philosophers reveal how the age-old struggle between body and soul led to the brain’s emergence as a curiosity in its own right. Investigating the intersection of the humanities and sciences in the works of authors ranging from William Shakespeare and John Donne to William Harvey, Margaret Cavendish, and Johann Remmelin, Lianne Habinek tells how early modernity came to view the brain not simply as grey matter but as a wealth of other wondrous possibilities – a book in which to read the soul’s writing, a black box to be violently unlocked, a womb to nourish intellectual conception, a creative engine, a subtle knot that traps the soul and thereby makes us human. For seventeenth-century thinkers, she argues, these comparisons were not simply casual metaphors but integral to early ideas about brain function. Demonstrating how the disparate fields of neuroscientific history and literary studies converged, The Subtle Knot tells the story of how the mind came to be identified with the brain.

Current Legal Issues, like its sister volume Current Legal Problems, is based upon an annual colloquium held at Univesity College London. Each year leading scholars from around the world gather to discuss the relationship between law and another discipline of thought. Each colloquium examines how the external discipline is conceived in legal thought and argument, how the law is pictured in that discipline, and analyses points of controversy in the use, and abuse, of extra-legal arguments within legal theory and practice. Law and Neuroscience, the latest volume in the Current Legal Issues series, offers an insight into the state of law and nueroscience scholarship today. Focussing on the inter-connections between the two disciplines, it addresses the key issues informing current debates.

This collection considers issues that have emerged in Early Modern Studies in the past fifteen years relating to understandings of mind and body in Shakespeare’s world. Informed by The Body in Parts, the essays in this book respond also to the notion of an early modern ‘body-mind’ in which Shakespeare and his contemporaries are understood in terms of bodily parts and cognitive processes. What might the impact of such understandings be on our picture of Shakespeare’s theatre or on our histories of the early modern period, broadly speaking? This book provides a wide range of approaches to this challenge, covering histories of cognition, studies of early modern stage practices, textual studies, and historical phenomenology, as well as new cultural histories by some of the key proponents of this approach at the present time. Because of the breadth of material covered, full weight is given to issues that are hotly debated at the present time within Shakespeare Studies: presentist scholarship is presented alongside more historically-focused studies, for example, and phenomenological studies of material culture are included along with close readings of texts. What the contributors have in common is a refusal to read the work of Shakespeare and his contemporaries either psychologically or materially; instead, these essays address a willingness to study early modern phenomena (like the Elizabethan stage) as manifesting an early modern belief in the embodiment of cognition.
