Nonproliferation And The Peaceful Uses Of Nuclear Energy

This third volume of the book series on Nuclear Non-Proliferation in International Law focuses on the development and use of nuclear energy for peaceful purposes within a contemporary global context, an interdependent characteristic of the Non-Proliferation Treaty along with disarmament and non-proliferation. The scholarly contributions in this volume explore this interrelationship, considering the role of nation States as well as international organizations such as the International Atomic Energy Agency (IAEA) in monitoring and implementing the Treaty. The 2015 Nuclear Accord with Iran and its implementation is also discussed, highlighting relevant developments in this evolving area. Overall, the volume explores relevant issues, ultimately presenting a number of suggestions for international cooperation in this sensitive field where political discussion often dominates over legal analysis. The International Atomic Energy Agency (IAEA) has the dual role of promoting the peaceful uses of nuclear energy and verifying that nuclear materials under its supervision are not diverted to military purposes (safeguards). Since 1958, in promoting the peaceful uses of nuclear energy through its technical cooperation program, IAEA has provided technical assistance to its member states by supplying equipment, expert services, and training that support the upgrading or establishment of nuclear techniques and facilities. Although the United States does not receive technical assistance, it has been the leading financial donor to IAEA'5 technical cooperation program. In March 1997, we reported to you on IAEA's technical assistance for Cuba, including assistance for the partially completed Cuban nuclear power reactors whose construction is suspended. As requested, this report examines (1) the purpose and effectiveness of IAEA's technical cooperation program, (2) the cost of U.S. participation in IAEA'5 technical cooperation program, and (3) whether the United States ensures that the activities of IAEA's technical cooperation program do not conflict with U.S. nuclear nonproliferation and safety goals.

This book examines the Nuclear Non-Proliferation Act of 1978 and other stringent non-proliferation laws that seek to tighten U.S. nuclear export criteria and strengthen the international non-proliferation regime. It juxtaposes efforts of nuclear managers with those of reformers who remain intent on strengthening safeguards to prevent horizontal proliferation. Dr. Beckman looks at the development of the Atoms for Peace program, the mindset that grew up along with it, and the shifts in congressional thought about the promise and problems of the peaceful nuclear fuel cycle.
